1.    Title

    (1) These Regulations may be cited as the Public-Private Partnership (Kasumbalesa Border Post) (User Fees) Regulations.

    (2) These Regulations shall come into operation on 4th March, 2023.

2.    Interpretation

In these Regulations, unless the context otherwise requires—

"Commissioner-General" has the meaning assigned to the words in the Zambia Revenue Authority Act*;

"customs area" has the meaning assigned to the words in the Customs and Excise Act*;

"user fee" means a charge payable for a vehicle for a single border crossing into or out of the Republic, whether loaded or empty; and

"vehicle" has the meaning assigned to the words in the Road Traffic Act, 2002*.

3.    Administration of Regulations

The Commissioner-General is responsible for the collection of user fees under these Regulations.

4.    User fee

The user fee payable for each vehicle, whether the vehicle is attached with an abnormal load or not, shall be as set out in the First Schedule.

5.    Parking fee

The fee payable for parking in a customs area beyond twenty-four hours after the release of a vehicle from customs control shall be 25 United States Dollars or Kwacha equivalent, per day or part of the day.

6.    Exemptions

Subject to these Regulations, an exemption from the payment of the user fee shall be granted in respect of a vehicle listed in the Second Schedule.

7.    Revocation of S.I. No. 99 of 2015

The Public-Private Partnership (Kasumbalesa Border Post) (User Fees) Regulations, 2015 are revoked.

SECOND SCHEDULE

EXEMPT VEHICLES

Description

Conditions for Grant of Exemption

Government vehicles for the Republic and the Democratic Republic of Congo (DRC)

Government licence plates or any other acceptable proof of Government ownership

Diplomatic vehicles

Subject to display of diplomatic licence plates

Vehicles owned by Government employees who are officially appointed and deployed to serve at the Kasumbalesa Border Post

Subject to proof of ownership and prior registration with the Zambia Revenue Authority

Non-commercial vehicles owned and driven by members of the frontier communities (Zambia/DRC)

The community must reside within the proximity of the border subject to pre-registration and other terms and conditions issued by the Zambia Revenue Authority
