1.   Title

This Order may be cited as the National Pension Scheme (Commencement) Order.

 

2.   Commencement of Act No. 40 of 1996

The National Pension Scheme Act, 1996, shall come into operation on the 1st February 2000.

1.   Title

These Regulations may be cited as the National Pension Scheme (Pensionable Earnings) Regulations.

 

2.   Definitions

In these Regulations , unless the context otherwise requires-

"earnings" means any benefits given by an employer in exchange for the employee's service whether explicit or implied, or in writing an may be paid in kind, cash, credit or securities including any allowance paid by the employer to the employee with regard to the cost of living and any payment of wages by way of severance benefit upon termination of employment whether the payment is fixed or determinable intervals of time or calculated in relation to set tasks or with regard to the number of tasks completed by the employee, or in relation to the volume of work completed by the employee;

"pensionable earnings" means the earning on which contributions to the Authority are levied and where a member's earning exceed the minimum threshold as set out in the fifth schedule to these Regulations, pensoinable earning are all the earnings in a given month that are less than the social ceiling; and

"social security" means the lowest level of earning on which no contribution to the Scheme is levied.

 

3.   National average monthly earnings

The national average monthly earnings and the period to which that average applies is set out in the First Schedule.

 

4.   Social security ceiling

The social security ceiling and period to which that ceiling applies is set out in the Second Schedule.

 

5.   Minimum total monthly contributions

The minimum total monthly contributions and the period to which those contributions applies is set out in the Third Schedule.

 

6.   Maximum total monthly contributions

The maximum total monthly contributions and the period to which those contributions applies is set out in the Fourth Schedule.

 

7.   Contributions

The contributions towards the Schedule shall be calculated at 10 per centum of pensionable earnings which shall be borne equally by the employee and the table of contributions and the period to which the contributions relate is set out in the Fifth Schedule.

1.   Title

The employer of the Fund established under the repealed Act are hereby transferred to the authority.

 

3.   Terms and conditions of employment

A person who is transferred under paragraph 2 shall enjoy terms and conditions with the Authority that are no less favourable than those enjoyed while employed by the Fun established under the repealed Act and for purposes of determining rights to or eligibility for any pension, gratuity, leave or other benefits, that person's previous service with the Fund shall be treated as service with the Authority.

SI 71 of 2000.

 

1.   Title

These Regulations may be cited as the National Pension Scheme (Benefits and Eligibility) Regulations.

 

2.   Retirement invalidity and survivor benefits

   (1) The Authority shall pay retirement or invalidity benefits to any member who satisfies the conditions set out in regulation 3.

   (2) Where a member eligible to the payment of any benefit under the Act dies, that member's benefits shall be paid to family dependants.

 

3.   Retirement pension

   (1) A member who is not eligible for a retirement pension under section 18 may be entitled to that pension if-

   (a)   the member has attained the age of 39 by 1st February, 2000 and has months of pensionable employment equal to not less than the number of months elapsing between the 1st February, 2000 and the day on which the member attains the age of 53, subject to a minimum of 60 completed months of pensionable employment; or

   (b)   the member is below the age of 39 and has made 180 monthly contributions in terms of sub-regulations (3) and (4).

   (2) For the purpose of ascertaining the number of contributions under sub-regulation (1)(b) a member may convert the months of contributions represented by a balance of the member's account under the repealed Act to months of pensionable employment under the Act.

   (3) A member may only convert months of pensionable employment under sub-regulation (2) if-

   (a)   the member establishes eligibility for a retirement benefit, an invalidity benefit or any other condition required under these Regulations;

   (b)   the member applies for the benefits to which that member is eligible;

   (c)   the member applies for a conversion of months of pensionable employment;

   (d)   the member, when taking into account the converted months is-

      (i)   qualified under paragraph (b), sub-regulation (1) of regulation 4; or

      (ii)   has made between 60 and 180 contributions 12 of which were made in the last 36 months;

   (e)   the member has not made any withdrawal or taken a benefit from the member's account under the repealed Act, since 1st February, 2000; and

   (f)   the member converts all assets in the account held under the repealed Act and surrenders all claims to any entitlement from the dissolved Board.

   (4) A member who qualifies for conversion under sub-regulation (3) shall be credited with three months of pensionable employment under the Act for each 12 months of contributions under the repealed Act

   (5) Where a member dies before attaining pensionable age and the member has months of pensionable employment under the repealed Act, the option to convert those months as required under sub-regulation (2) may only be exercised by the Director-General who shall do so in the best interests of the deceased members surviving children.

 

4.   Computation of retirement pension

   (1) The monthly retirement pension under section 19 of the Act due to member shall be calculated as follows-

Where:

"G" is the monthly pension;

"AIME" is the Average Indexed Monthly Earnings; and

"M" is the number of months of pensionable employment.

   (2) For the purposes of these Regulations the Average Indexed Monthly Earnings are calculated by adding a member's indexed monthly earnings over the entire period of contribution and dividing them by the total number of months of contribution.

   (3) The index (I) applied to arrive at the indexed earnings under sub-regulation (2) shall be determined as follows-

"Qn" is the national average earnings figure applicable in the year in which the member retires.

"Qm" is the national average earnings figure applicable in each year of the members service period from the year m = 1 to m = j

where j is the year preceding the year for Qn.

 

5.   Computation of early retirement benefits

The early retirement benefit due to an eligible member shall be calculated as follows-

"P" is the early retirement pension;

"G" is the monthly pension; and

"M" is the number of months between a member's date of retirement and the attainment of the age of 55.

 

6.   Calculation of national average monthly earnings

The National Average Monthly Earnings for the purposes of sub-section (4) of section 19 shall be the National Average Monthly Earnings in the second quarter of the previous year.

 

7.   Annual adjustment of pensions

   (1) Any pension payable under these Regulations shall be adjusted annually by an index derived as follows-

Where:

"Pj" is the adjusted pension paid beginning the new year;

"Pd" is the pension paid in the last month of the old year; and

"Q" is the pension adjustment quotient reflecting the change in national average earnings in the second quarter from one year to the next in the two years preceding the year in which the adjustment is made.

   (2) Adjustments under paragraph (1) shall take effect every January for all benefits in payment in the previous year.

 

8.   Lump sum payment

   (1) A lump sum benefit payable under the Act shall be calculated as follows-

Where:

"L" is lump sum payable;

"Sc" is the number of indexed monthly contributions;

"n" is number of months of pensionable employment; and

"I1, I2..In" is the total interest on contributions made in the first, second and subsequent months of pensionable employment beginning with the month in which it is paid, through to the last month in which any contribution attracts interest and this being the last month before the month in which the lump sum is payable.

   (2) The calculation of the interest accumulated between the month in which the first contribution is made and the last month before the month in which the lump sum is payable shall be based on the following formula-

Where:

"Ii" is the total interest on contributions made in the i-th month beginning with the month in which it is paid continuing to the final month in which interest accrues;

"Cj" is the raw contribution rate for the i-th month;

"ij" is the nominal monthly interest charge for the em-th month which is the final month in which interest accrues; and

"im" is the nominal monthly interest charge for the m-th month which is the final month in which interest accrues.

 

9.   Computation of invalidity pension

   (1) The invalidity benefit due to a member under section 24 of the Act shall be calculated as follows-

Where:

"P" is the monthly rate of the invalidity pension to be determined for the member;

"C" is the compensation for last years, equal to 0.005 (AIME)N where "AIME" is the Average Indexed Monthly Earnings and "N" is the number of years lost from works As a result of invalidity;

"G" is the monthly pension;

"Pm" is the minimum pension; and

"MAX (G,PM)" is the greater of G and Pm.

   (2) The rate at which a member whose invalidity payment has been converted to a retirement benefit shall be paid, shall be that of the member's invalidity payment or the retirement pension, whichever is greater.

 

10.   Invalidity lump sum

   (1) The Authority shall pay a lump sum invalidity payment to a member in accordance with section 26 if the member-

   (a)   has applied for invalidity payment;

   (b)   has not reached pensionable age;

   (c)   has made at least 12 months of pensionable employment and does not qualify under regulation 3 sub-regulation 1(b) or regulation 3 sub-regulation (3)(d)(ii); and

   (d)   is declared to be disabled by the Authority.

   (2) The manner of calculating the lump sum benefit under this Regulation shall be as prescribed under Regulation 10.

 

11.   Survivors pension and lump sum

   (1) The pension or lump sum that a survivor receives is computed as provided in sub-regulations (3) and (4).

   (2) The availability sum on a deceased member's earnings record is-

   (a)   if the deceased member was receiving a pension on the date of the death; or

   (b)   if the deceased member was not receiving a pension on the date of death, and if that member was-

      (i)   of pensionable age, the monthly retirement pension for which the member was eligible at the time of death; or

      (ii)    not of pensionable age, the monthly invalidity pension computed as though the member was disabled using the date of death as the date of onset of the invalidity.

   (3) The availability sun on the deceased members earning record is divided into shares by employing the following formula-

N= 1 + P1 + P2 + P3 + P4 + P5 + P6

Where:

"N" is the number of available shares;

"P1" is the number of all surviving spouses, including pregnant spouses multiplied by two;

"P2" is the number of surviving children under the age of 18;

"P3" is the number of children below the age of 25 who are receiving full time instructions at an educational institution;

"P4" is the number of pregnant surviving spouses;

"P5" is the number of non-surviving spouses with at least one minor child by the deceased; and

"P6" is the number of children of the deceased of any age who are either physically or mentally incapacitated both by the age of 18 and the death of the member.

   (4) A person eligible to a pension shall receive a pension consisting of a number of shares and for a period of time as follows-

   (a)   a spouse who is 45 years old at the death of a member shall receive a pension equal to two shares for life or until remarriage;

   (b)   a spouse who is below 45 years at the death of a member and who has the care of one or more minor children by the deceased member shall receive a pension equal to 2 shares for life or until remarriage;

   (c)   a spouse who is below 45 years at the death of a member and who does not have the care of a minor child by the deceased shall receive a pension equal to two shares for 2 years from the date of the member's death;

   (d)   any child of the deceased member below 18 years at the time of death and any child conceived within the 9 months preceding the deceased's death shall receive a pension equal to one share until the attainment of the age of 18, or so long as the child remains in full-time instruction at an educational institution, but not beyond the age of 25;

   (e)   children of a non surviving spouse by the deceased member shall, in addition to the share allocated under sub-paragraph (d):

divide one share equally among themselves until the attainment of the age of 18, or so long as the child remains in full time instruction as an educational institution, but not beyond the age of twenty-five:

Provided that where there is only one child by a deceased spouse, that child shall receive the benefit of the entire share;

   (f)   any child of the deceased who is receiving full-time instruction at any educational institution and who is above the age of 18 years but below the age of 25 years at the time of the deceased member's death shall receive a pension equal to one share until the child ceases to receive instructions at an educational institution or attains the age of 25 whichever occurs first, or

   (g)   any child who is physically or mentally handicapped.

   (5) A survivor who is eligible to a survivors lump sum shall receive that benefit divided as follows-

   (a)   a spouse who is 45 years or older at the time of the deceased member's death shall receive a lump sum equal to two shares;

   (b)   a spouse who is below the age of 45 years at the time of the deceased member's death and has the care of one or more minor children by the deceased shall receive a lump sum equal to two shares;

   (c)   a spouse who is below the age of 45 years at the time of the deceased member's death and does not have care of any minor child by the deceased shall receive a lump sum equal to two shares;

   (d)   any child below the age of 18 years and any child conceived within the last 9 preceding months before the deceased member's death shall receive a lump sum equal to one share;

   (e)   children of a deceased spouse by the deceased member shall, in addition to the share allocated under sub-paragraph (d), divide equally among themselves a lump sum equal to one share:

Provided that where there is only child of the deceased member by a deceased spouse that child shall enjoy the benefit to the lump sum of the entire share;

   (f)   a child of a deceased member who is receiving full time instruction at an educational institution and is above the age of 18 years but below 25 years shall receive a lump sum equal to one share; or

   (g)   a physically or mentally incapacitated child who was incapacitated both before the age of 18 years and the death of the member shall receive a lump sum equal to two shares.

 

12.   Payment and adjustment of pensions

   (1) Where a survivor gives consent, the Authority may pay a survivor's pension quarterly or at other intervals as may be determined.

   (2) Every survivor's pension shall be paid to the person entitled to that pension unless-

   (a)   the person entitled to the pension is a child under the age of 16 years in which case the pension shall be paid to the parent or guardian having the care of that child;

   (b)   a person is appointed to exercise, on behalf of a child under the age of 16 years without a parent or guardian, or on behalf of an adult who is unable by reason of severe physical or mental incapacity to deal with one's affairs, any right to which the person may be entitled under the Act.

 

13.   Funeral grant

   (1) The Authority shall pay a Funeral grant to any person who has and, or is liable for the cost of the funeral of the deceased.

   (2) The Authority shall pay a funeral grant on the earnings record of a deceased member if, at the time of death, the deceased member was eligible under regulation 3, sub-regulation (1) or was in receipt of a retirement pension.

   (3) For the purpose of sub-regulation (2) a person is responsible for the payment of funeral expenses if-

   (a)   the person is the surviving spouse of the deceased member and the spouse applies for the benefit; or

   (b)   if the deceased member was not married at the time of death, the person is the parent or child of the deceased or other person who paid or was liable to pay the funeral expenses.

   (4) The amount of the funeral grant shall be ten times the amount of minimum pension in the year of the deceased member's death.

GENERAL

 

14.   When pension is payable

   (1) Any pension payable under the Act and these Regulations shall be paid monthly from the date the beneficiary became eligible or from the date, six months prior to the date of the claim whichever is earlier.

   (2) A pension shall cease in the month in which the beneficiary's entitlements ceases or in the month following the month in which the beneficiary dies if that beneficiary remains entitled.

 

15.   Receipt of only one pension at a time

   (1) A person who is entitled to two or more pension shall not receive them at the same time but shall elect to receive whichever pension that the pension desires.

   (2) The election of one benefit under sub-regulation (1) does not nullify the person's entitlement to other benefits.

   (3) Where the election of one benefit is made as provided by sub-regulation (1) the Authority shall suspend payment of the other benefit or benefits which benefits shall be revived in the event the elected benefit terminates or becomes less advantageous.

 

16.   Payment to person residing abroad

   (1) The Authority may pay a benefit to a abroad or on behalf of a person residing abroad who is eligible to a benefit under the Act and these Regulations if reciprocal arrangements exist between Zambia and that other country.

   (2) Where no reciprocal arrangements exist in the country that a beneficiary resided, the benefits to which that person is entitled shall be paid in Zambia to a person appointed to act in that behalf.

 

17.   Application for benefit

An application for a benefit payable under the Act and these Regulations shall be in Form 1 set out in the Schedule to these Regulations.

 

18.   Responsibility of beneficiary

   (1) The Authority shall notify a pensioner of the responsibilities arising under the Act and these Regulations as follows-

   (a)   when the determination is that a claimant is entitled to a survivors pension-

      (i)   the amount of the awards;

      (ii)    the notice period of 14 days in the requests to provide information needed to determine continued eligibility and whether an adjustment in the pension must be made;

      (ii)    the penalty of suspension for failure to comply to a request for information; and

      (iv)    the responsibility to comply by the Act and these Regulations in respect of payments.

   (b)   when the awards is an invalidity pension-

      (i)   to report earnings to the Authority within 14 days of their receipt; and

      (ii)    to notify the Authority immediately of an improvement in a pensioners impairement that would allow engagement in substantially gainful employment.

   (c)   when the award is a survivors benefit-

      (i)   if the survivor is a spouse below the age of 45 years with a minor child or a spouse above 45 years, the requirement to notify the Authority within 14 days of remarriage;

      (ii)   if the survivor is a child between 18 and 25 years of age receiving full-time instruction at an educational institution;

the requirement to inform the Authority on ceasing or completing such instruction within 14 days; and

      (iii)   if the survivor is a child with a physical or mental incapacity, the guardian or other representative should inform the Authority of the earnings and of any improvement in the capacity that would allow the child to engage in substantial gainful employment.

 

19.   Interest in ZNPF account

Interest and return on investment shall accrue in accounts maintained under the repealed Act, as prescribed under that Act.

 

20.   Conversion of ZNPF accounts

Where a member applies for retirement or invalidity benefit, that member shall have the option to-

   (a)   take the benefits to which the member is entitled under the repealed Act; or

   (b)   subject to the restriction under regulation 19, exchange the rights under the repealed Act for the rights under the Act and these Regulations.

 

21.   Limitation on payment of funeral grant

   (1) The Authority shall only pay a funeral grant for the death of any person on the earnings record of the deceased under the repealed Act or on the deceased earning's record under the Act and these Regulations.

   (2) The person eligible for payment of the funeral grant under these Regulations shall elect to receive one of the payments stipulated under sub-regulation (1).

This form has to be filled in whenever you are applying for any of the benefits payable under the National Pension Scheme Act. Before you complete this form, please ensure that you carefully read through the instructions below.

MISREPRESENTATION OF FACTS

Any person who makes a false statement or representation or produces or furnishes or causes to be produced or furnishes any information which he knows to be false in a material particular commits an offence under Section 51 of the National Pension Scheme Act No. 40 of 1996.

RETIREMENT PENSION

To qualify for retirement pension you should have met the following conditions:

1. You should have attained the pensionable age of 55 years and;

2. You should have either made at least 180 months contributions to NPSA; or

3. You should have made the minimum number of contributions specified under regulation 3 if you were 39 years or older by 1st February, 2000; or

4. you should have made up the minimum required number of 180 contributions by converting your ZNPF balance. The Act allows to convert every one year contributed under the ZNPF to 3 months under NAPSA. This applies only to members who were below 30 years old at 1st February, 2000.

SURVIVORS PENSION

You may claim survivors benefit if you were a registered dependant of the deceased. In addition you need to produce a certified true copy of the Death Certificate, Burial Permit, Police Report or such other authentic and acceptable evidence confirming the death of the member should be attached. The Authority will only pay survivor's benefit to eligible survivors.

INVALIDITY BENEFIT AND FUNERAL GRANT

To qualify for an Invalidity Benefit, you should have contributed for at least 60 months. All applications for invalidity benefits will be subjected to scrutiny by the Medical Board appointed by the Authority.

To qualify for Funeral Grant, you should have contributed for at least 12 months.

Time Frame:

Any claim under the National Pension Scheme Authority should be lodged with the Authority within six months of the death or retirement or invalidity of the member.

How to complete the Form:

1.   Title

These Regulations may be cited as the National Pension Scheme (Medical Board) Regulations.

 

2.   Interpretation

In these Regulations, unless the context otherwise requires-

"gainful employment" means employment in respect of which an employee is remunerated by the employer and the remuneration qualifies the employee to contribute to the Scheme;

"medical board" means a board established by the Authority pursuant to section 27 of the Act;

"permanent invalidity" means a physical or mental inability suffered by a person, which renders that person incapable of engaging in gainful employment; and

"scheme" has the meaning assigned to it in the Act.

 

3.   Qualification for invalidity benefit

A person qualifies for an invalidity benefit if that person satisfies conditions set out in regulations 3 and 10 of the National Pension Scheme (Benefits and Eligibility) Regulations, 2000.

 

4.   Application for invalidity benefit

The Director General shall refer an application for invalidity benefit to a medical board in Form I set out in the Schedule.

 

5.   Notice of hearing

   (1) A medical board shall, within 14 days of receipt of an application for invalidity benefit under regulation 4-

   (a)   set a date for the hearing; and

   (b)   issue to the applicant, a notice of hearing in Form II set out in the Schedule.

   (2) A person serving the notice of hearing under sub-regulation (1) shall request the person served to acknowledge receipt of the notice in Form III set out in the Schedule.

 

6.   Determination of claim

   (1) A medical board shall, in determining a claim under these Regulations, take into account-

   (a)   the medical status of the applicant;

   (b)   whether the applicant has suffered a permanent invalidity;

   (c)   the date of the onset of the permanent invalidity; and

   (d)   the age of the applicant.

   (2) A medical board shall hear and determine a claim within 120 days of the date of receiving the claim.

 

7.   Powers of medical board

   (1) A medical board may, for the purpose of any hearing-

   (a)   receive evidence;

   (b)   summon and administer an oath or affirmation to a witness; and

   (c)   require the production of any book, record, document, electronic record or anything required for the purpose of the proceeding.

   (2) A summons issued under these Regulations shall be in Form IV set out in the Schedule.

   (3) A person summoned to attend before a medical board who, without reasonable excuse-

   (a)   refuses or fails to attend at the time and place specified in the summons or having attended, leaves without the permission of the medical board;

   (b)   having attended before the medical board, refuses to be sworn or to affirm;

   (c)   refuses to answer fully and satisfactorily to the best of that person's knowledge and belief, any questions lawfully put to that person; or

   (d)   refuses to produce any book, record, document or thing which that person has been required by summons to produce;

commits an offence and is liable, upon conviction, to a fine not exceeding two thousand five hundred penalty units or to imprisonment for a term not exceeding two years, or to both.

   (4) A person summoned by a medical board under this Regulation shall be paid such allowances as may be determined by the Authority.

 

8.   Proceedings of medical board

   (1) Three members of a medical board form a quorum.

   (2) There shall preside at a meeting or hearing of a medical board-

   (a)   the Chairperson;

   (b)   in the absence of the Chairperson, the Vice-Chairperson; or

   (c)   in the absence of both the Chairperson and the Vice-Chairperson, such member as the members present may elect for the purposes of that meeting or hearing.

   (3) A decision of the medical board on any question shall be by a majority of the members present and voting at the meeting or hearing and in the event of an equality of votes, the person presiding at the meeting or hearing shall have a casting vote, in addition to that person's deliberative vote.

   (4) The proceedings of a medical board shall be in camera.

   (5) A medical board may invite any person whose presence is in its opinion desirable to attend and to participate in the deliberation of the meeting or hearing of the medical board, but that person shall not have any vote.

   (6) A medical board shall cause to be kept a record of its proceedings.

   (7) A party to the hearing of a medical board may appear in person or be represented by a legal practitioner, a legal representative or immediate former employer where the circumstances leading to the making of an application for invalidity benefit occurred while in the service of that former employer.

   (8) A member of a medical board shall not participate in a hearing of a claim of invalidity benefit if that member-

   (a)   is directly or indirectly interested in a private capacity in a matter that is the subject of consideration; or

   (b)   has had any professional responsibility for the person with respect to the conduct giving rise to the claim.

   (9) A disclosure of interest made under this regulation shall be recorded in the minutes of the meeting or hearing at which it is made.

 

9.   Decision and report by medical board

   (1) A decision of a medical board shall be in the form of an award or a medical report and a copy of the report shall be supplied to each party to the proceedings within 14 days of the decision.

   (2) A medical board shall, as soon as practicable after the completion of a hearing, submit to the Authority, a report of the proceedings and a copy of the award or medical report.

 

10.   Appeal

   (1) A person dissatisfied with a decision of a medical board may appeal to the Minister, within 30 days of receiving the decision.

   (2) The Minister shall determine the claim within 30 days of receiving the appeal.

   (3) An appeal under sub-regulation (1) shall be in Form V set out in the Schedule.

   (4) A person dissatisfied with the decision of the Minister may, within 30 days of receiving the decision, appeal to the High Court.

1.   Title

These Regulations may be cited as the National Pension Scheme (Investment) Regulations.

 

2.   Interpretation

In these Regulations, unless the context otherwise requires-

"associate" has the meaning assigned to the word in the Anti-Corruption Act, 2012;

"asset allocation" means the division of investments among different kinds of assets in order to optimise the risk and return tradeoff based on the management objectives of the Scheme;

"asset class" means a group of securities, investments or products that have similar financial characteristics, behave similarly in the market place, and are subject to the same laws and regulations;

"bank" has the meaning assigned to the word in the Banking and Financial Services Act;

"collective investment or mutual fund" means a company that collects funds from individual investors and invests the funds in a wide range of securities or other assets;

"corporate bond" means a listed or unlisted debt security which has a tenor of more than one year and includes a term note issued by a corporation and sold to an investor in order to raise funds or capital in the capital markets;

"diversification" means a portfolio mix designed to reduce exposure to risk;

"economically targeted investment" includes risk adjusted rate investments done for economic stimulation purposes;

"financial institution" has the meaning assigned to the word in the Banking and Financial Services Act;

"green field investment" means an investment in a startup company that is in the initial stage of its operations;

"government bond" means a debt security with a tenor of more than one year issued by the Bank of Zambia on behalf of the Government;

"government security" means a government bond or treasury bill;

"infrastructure" means structures, systems and facilities serving the economy of the Republic and includes roads, utility lines and public buildings;

"investment advisor" means a person or a management company affiliated with that person appointed to provide investment advisory services to the Authority;

"investment funds" means a pool of capital that is available for investment in securities;

"investment manager" means a company or institution appointed by the Authority to make investments in securities on behalf of the Authority;

"relative" means-

   (a)   a person's son, daughter, brother, sister, nephew, niece, parent, uncle, aunt, grandparent or cousin; or

   (b)   a person's spouse or the spouse of the persons mentioned in paragraph (a);

"socially targeted investment" includes an investment made in order to bring about social good and improve the human condition and intended to enable citizens, groups, organisations, cultures and society have a more positive future and expected to be enjoyed by a large number of citizens on a large scale;

"special purpose vehicle" means a subsidiary company with an asset and liability structure that makes its obligations secure even if the parent company becomes insolvent; and

"treasury bill" means a debt security with a tenor of less than one year issued by the Bank of Zambia on behalf of the Government.

 

3.   Investment principles

   (1) The Authority shall, in making and maintaining investments, be guided by the following principles-

   (a)   capital preservation;

   (b)   investment returns and liquidity; and

   (c)   asset-liability matching.

   (2) The Authority shall ensure that investment funds are managed prudently.

   (3) Without limiting the generality of sub-regulation (2), the Authority shall-

   (a)   segregate its investment funds into separate portfolios each governed by its own operational guidelines issued by the Board;

   (b)   develop a list of asset classes which a portfolio will be permitted to hold;

   (c)   establish detailed asset allocation rules for its investment managers which-

      (i)   specify the extent of a portfolio that can be invested in a single class of assets;

      (ii)   ensure that investments conform to a portfolio's investment objectives;

      (iii)   provide for the rebalancing of a portfolio over time and give investment managers a reasonable time within which to attain compliance.

 

4.   Prudential investment management principles

The Authority shall prudentially manage the Scheme and-

   (a)   act in the sole interest of the members;

   (b)   maximise the Scheme's or Authority's investments;

   (c)   diversify the Scheme's portfolio and limit its risk of loss attributable to investment in a company or group of companies;

   (d)   ensure liquidity of the Scheme;

   (e)   invest with due regard to the duration or term of the Scheme's liabilities; and

   (f)   appoint suitably qualified professionals to the Authority to manage the Scheme and ensure that investment managers have suitably qualified professionals for purposes of making investments in securities on behalf of the Authority.

 

5.   Fiduciary duties

   (1) The Authority shall discharge its fiduciary duties as a trustee of the Scheme.

   (2) The Authority shall not invest in-

   (a)   a company in which a member of the Authority, committee of the Authority, Director-General, Secretary or other members of staff of the Authority or a relative or associate of any of these persons holds more than 10 per cent of that company's shares; or

   (b)   an entity that is the Authority's investment manager or associated with a company referred to in paragraph (a).

 

6.   Allowable investment

The Authority may invest any liquid assets of the Scheme that are not immediately required to meet any charges or obligations in-

   (a)   securities listed on the Lusaka Securities Exchange or such other Securities Exchange as the Authority may designate;

   (b)   non-listed equities;

   (c)   bank deposits in a bank or financial institution licensed or established under any written law of the Republic of Zambia or by the laws of the United Kingdom of Great Britain and Northern Ireland;

   (d)   underwriting;

   (e)   collective investments;

   (f)   infrastructure;

   (g)   socially and economically targeted investments;

   (h)   special purpose vehicles created by the Authority; and

   (i)   green field investments.

 

7.   Limits of allowable investments

The following are the allowable investment limits for the asset classes referred to in section 41 of the Act and regulation 6-

   (a)   a minimum of two and a half per cent of the Scheme's investment portfolio size for lending to the Government;

   (b)   a maximum of 25 per cent of the issued shares per entity for listed equities, except that not more than 70 per cent of the investment funds shall be invested in listed equities;

   (c)   a maximum of 10 per cent of the total investment portfolio size for non-listed equities;

   (d)   a maximum of 25 per cent of the issue in any one listed bond by the same issuer for listed debt securities other than bonds issued by the Government under paragraph (a);

   (e)   bank deposits not exceeding five per cent of the investment portfolio in a single financial institution, except holdings in the Bank of Zambia or premium settlement account for money pending investments elsewhere;

   (f)   a maximum of 30 per cent of the size of the investment portfolio for real estate;

   (g)   a maximum of five per cent of the investment portfolio for underwriting of transactions but to be undertaken as a sublimit within the equity limit;

   (h)   in relation to collective investments, a maximum of-

      (i)   five per cent of the investment portfolio; or

      (ii)   two and half per cent of the investment portfolio;

   (i)   a maximum of 15 per cent of the investment portfolio size in relation to infrastructure;

   (j)   a maximum of one and half per cent of the investment portfolio size for economically targeted investments and a maximum of one per cent of the investment portfolio size for socially targeted investments;

   (k)   a maximum of 10 per cent of the investment portfolio size in equity in a special purpose vehicle created by the Authority to the exclusion of any other body; and

   (l)   a maximum of 15 per cent of the investment size in green field investments subject to the approval of the Minister.

 

8.   Prohibited investments

   (1) Despite the generality of allowable investments provided for in regulation 6, the Authority shall not-

   (a)   engage in equity investments or direct lending in companies that are listed but have not operated profitably for the immediate past three years as confirmed by financial statements audited by an audit firm recognised by the Zambia Institute of Chartered Accountants;

   (b)   engage in speculative investments involving forward contracts or derivatives;

   (c)   engage in direct lending to non-listed companies where the Authority's indebtedness is subordinated to the companies"™ other liabilities; or

   (d)   hold a stake of more than 15 per cent in any group of associated companies.

   (2) The Authority may use a derivative instrument to hedge against an identified risk.

 

9.   Appointment of investment managers

   (1) The Authority shall appoint persons licensed as managers under the Pension Scheme Regulation Act investment managers to manage the investment portfolio of the Scheme.

   (2) An investment manager shall be appointed on the basis of a competitive tender process that takes into account history and past performance, and experience, size and assets to be managed, quality and proposed fee structure, except that investment managers shall not have access to the actual funds or securities.

   (3) The Authority shall not appoint, as investment managers, persons who have a financial relationship or are related to the Authority's trustees or managers.

 

10.   Establishment of market benchmarks

   (1) The Authority shall develop and establish market benchmarks to assess the performance of its investment managers.

   (2) The Authority shall communicate with its members-

   (a)   in the form of a booklet that explains the provisions of the Scheme, summarises the rights of members and delineates the responsibilities of the Authority;

   (b)   by providing annually to its members contributions statements at such intervals as the Authority may decide; and

   (c)   by publishing audited financial reports on an annual and timely basis.

 

11.   Appointment of custodians

The Authority may appoint custodians for its investment activities of the Scheme.

 

12.   Appointment of auditor

Subject to the Public Audit Act, 2016, the Authority shall appoint an auditor for each financial year who shall not-

   (a)   be a shareholder in a company or in any way be associated with any person providing asset management or other services to the Authority;

   (b)   have any financial relationship with any member of the Authority, the Director-General, Secretary or other staff of the Authority or any service provider to the Authority.

 

13.   Appointment of professional advisor

The Authority may, for purposes of performing its functions, appoint an appropriately experienced independent advisor to advise the Authority in relation to the prudential principles and investments.

 

14.   General offence and penalty

A person who contravenes a provision of these Regulations commits an offence and is liable, upon conviction, to a fine not exceeding two thousand five hundred penalty units or to imprisonment for a term not exceeding two years, or to both.

SI 72 of 2019.

 

1.   Title

   (1) These Regulations may be cited as the National Pension Scheme (Informal Sector) (Membership and Benefits) Regulations.

   (2) A person referred to in the Second Schedule who successfully lodges an application with the Scheme shall be a member from the date of registration.

 

2.   Application

   (1) These Regulations apply to a person listed in the Second Schedule.

   (2) A person referred to in the Second Schedule who successfully lodges an application with the Scheme shall be a member from the date of registration.

   (3) A person to whom these Regulations apply is not liable to pay the penalty specified under section 15(2) of the Act.

 

3.   Interpretation

In these Regulations unless the context otherwise requires-

"Authority" means the National Pension Scheme Authority established under section 3 of the Act;

"beneficiary" means the registered spouse, child or dependant of a member and includes a child conceived within nine months preceding the deceased member's death;

"child" has the meaning assigned to the word in the Intestate Succession Act;

"dependant" has the meaning assigned to the word in the Intestate Succession Act;

"household" means an individual or a group of individuals who normally live together, have a common provision for food or other essentials for living and they have only one person whom they all regard as the head of the household, regardless of whether those persons are blood related;

"informal sector" means a group of production units comprised of unincorporated enterprises by households including own account enterprises;

"member" means a self-employed person registered as a member under these Regulations; and

"selfemployed worker" means a person engaged in work on their own account or in an enterprise of informal employees.

 

4.   Eligibility to become member

A person listed in the Second Schedule is eligible to become a member of the Scheme.

 

5.   Contribution rate

A member shall pay a monthly contribution at the rate of 5.4 per cent of selfemployed workers annual average earnings in the base year subject to the annual review in line with earnings growth in the formal sector as shall be determined by the Minister by guidelines.

 

6.   Crediting contributions

The Authority shall credit a contribution from a member in the year or month in which the contribution is made, except that a member who joins the scheme during the course of the year is not required to make a contribution retrospectively.

 

7.   Portability of accrued rights

A member may convert the accrued rights and benefits under these Regulations to the rights in the Scheme by a conversion ratio of 2:1 from the informal to the formal sector at retirement or invalidity.

 

8.   Concurrent membership

A member of the Scheme may voluntarily become a concurrent member of the Scheme under the formal and informal sectors under these Regulations.

 

9.   Benefits

The Authority shall pay retirement, early retirement, invalidity, survivors, maternity and family funeral benefits to an eligible member under these Regulations.

 

10.   Retirement pension

   (1) The Authority shall pay a retirement pension to a member who-

   (a)   has attained pensionable age;

   (b)   has made not less than 120 monthly contributions or 10 years contributions; and

   (c)   is within 5 years before attaining the pensionable age and has made at least 120 monthly contributions or 10 years contributions.

   (2) The amount of the pension paid under sub-regulation (1)(c) shall be calculated in accordance with the formula set out under paragraph 5 of the First Schedule.

 

11.   Early retirement pension

   (1) A member qualifies for early retirement pension if that member is within 5 years before attaining pensionable age and has paid at least 120 months contributions.

   (2) The amount of pension paid on early retirement under this regulation is the amount payable under paragraph 5 of the First Schedule.

   (3) An early retirement pension is not payable if the amount of pension calculated in accordance with the provisions of sub-regulation (2) is lower than the minimum pension under regulation 13.

   (4) An early retirement pension is not payable if the amount of the pension calculated in accordance with the provisions of regulation 10(1)(c) and sub-regulation (2) is lower than the minimum pension under regulation 13.

 

12.   Computation of retirement pension

The Authority shall pay a retirement pension as set out in paragraph 1 of the First Schedule.

 

13.   Minimum pension

The minimum monthly pension for a member shall be calculated based on the formula set out in paragraph 2 of the First Schedule.

 

14.   Retirement lump sum

A member who has attained pensionable age but does not meet the qualifications for a pension under regulation 10 is entitled to the payment of a lump sum calculated in accordance with the formula set out in paragraph 7 of the First Schedule.

 

15.   Invalidity pension

The Authority shall pay an invalidity pension to a member who-

   (a)   has suffered permanent invalidity as determined under sections 27 and 28 of the Act; and

   (b)   is under pensionable age and has either-

      (i)   made 120 monthly contributions or annual equivalent contributions; or

      (ii)   made at least 60 monthly contributions, of which 12 or more were paid in the period of 36 months immediately preceding the date the invalidity began.

 

16.   Computation of invalidity pension

The Authority shall compute an invalidity benefit with the formula set out in paragraph 6 of the First Schedule.

 

17.   Invalidity lump sum

The Authority shall pay a lump sum invalidity payment to a member if that member-

   (a)   has applied for an invalidity benefit;

   (b)   has not reached pensionable age; and

   (c)   does not meet the requirements for invalidity pension as provided in regulation 15(1).

 

18.   Computation of invalidity lump sum

The invalidity lump sum shall be calculated as set out in paragraph 7 of the First Schedule.

 

19.   Maternity benefit

   (1) The Authority shall pay a maternity benefit to an eligible member in accordance with these Regulations if that member-

   (a)   has been a member of the scheme for at least 24 months preceding the date of that member's delivery; and

   (b)   the member has made at least 12 months contributions or an equivalent of the annual minimum contribution applicable in that year in the last 36 months preceding the date of delivery.

   (2) A member is only entitled to the maternity benefit if that member makes a claim within six months from the date of that member's delivery.

   (3) The maternity benefit shall be restricted to a maximum of six claims per contributing member.

   (4) A member shall only be entitled to be paid a maternity benefit once every two years.

   (5) A maternity benefit will provide a 50 per cent computation of income replacement based on the monthly average earnings of self-employed workers for a duration of three and half months being maternity leave as provided under section 41 of the Employment Code Act, 2019.

 

20.   Survivor's benefit

   (1) The Authority shall pay a survivor's benefit to an eligible member under these Regulations based on the deceased member's earning records as set out in paragraph 8 of the First Schedule.

   (2) The available sum on a deceased member's computation of earning record shall be divided into shares of survivors as set out in paragraph 9 of the First Schedule.

 

21.   Survivor's pension benefit

   (1) A survivor's pension shall be paid to a survivor's family member or a registered pension dependant if, at the time of death, the member-

   (a)   was in receipt of a retirement pension or an invalidity pension;

   (b)   would have been entitled to an invalidity pension for permanent invalidity at the time of death; or

   (c)   had reached pensionable age and was entitled to a retirement benefit.

   (2) A person shall be eligible to receive a survivor's pension benefit as follows-

   (a)   a spouse who is 45 years old or above at the time of a member's death, shall receive a pension equal to two shares for life or until remarriage;

   (b)   a spouse who is below 45 years at the time of death of a member and who has the care of one or more minor children by the deceased member shall receive a pension equal to two shares for life or until remarriage;

   (c)   a spouse who is below 45 years at the time of death of a member and who does not have the care of a minor child by the deceased shall receive a pension equal to two shares for 2 years from the date of the member's death;

   (d)   a child of the deceased member below the age of 18 years at the time of death of a member and any child conceived within the 9 months preceding the deceased's death shall receive a pension equal to one share until the attainment of the age of 18, or so long as the child remains in full time instruction at an educational institution, but not beyond the age of 25;

   (e)   children of a non-surviving spouse by the deceased member shall, in addition to the share allocated under sub-paragraph (d), divide one share equally among themselves until the attainment of the age of 18, or so long as the child remains in full time instruction at an educational institution, but not beyond the age of 25, except that where there is only one child by a deceased spouse, that child shall receive the benefit of the entire share;

   (f)   any child of the deceased who is receiving full time instruction at an educational institution and who is above the age of 18 years but below the age of 25 years at the time of the deceased member's death shall receive a pension equal to one share until the child ceases to receive instructions at an educational institution or attains the age of 25, whichever occurs first; or

   (g)   any child who is physically or mentally handicapped.

 

22.   Survivor's lump sum

   (1) A survivor's lump sum shall be paid to a family member or a dependant if, at the time of that member's death, the member did not satisfy the qualifying conditions for a survivor's pension specified in regulation 21.

   (2) A person is eligible to receive a survivor's lump sum benefit as follows-

   (a)   a spouse who is 45 years or older at the time of the deceased member's death shall receive a lump sum equal to two shares;

   (b)   a spouse who is below the age of 45 years at the time of the deceased member's death and has the care of one or more minor children by the deceased shall receive a lump sum equal to two shares;

   (c)   a spouse who is below the age of 45 years at the time of the deceased member's death and does not have the care of any minor child by the deceased shall receive a lump sum equal to two shares;

   (d)   any child below the age of 18 years and any child conceived within the last 9 months preceding the deceased member's death shall receive a lump sum equal to one share;

   (e)   children of a deceased spouse by the deceased member shall, in addition to the share allocated under sub-paragraph (d), divide equally among themselves a lump sum equal to one share, except that where there is only one child of the deceased member by a deceased spouse, that child shall enjoy the lump sum benefit of the entire share;

   (f)   a child of the deceased member who is receiving full time instruction at an educational institution and is above the age of 18 years but below 25 years shall receive a lump sum equal to one share; or

   (g)   a physically or mentally challenged child who was incapacitated both before the age of 18 years and the death of the member shall receive a lump sum equal to one share.

 

23.   Payment and adjustment of pension

   (1) Where a survivor gives consent, the Authority may pay a survivor's pension quarterly or at any other interval as may be determined.

   (2) A survivor's benefit shall be paid to the person entitled unless the person entitled to the survivor's benefit is a child under the age of 16 years, or is an adult who is unable by reason of physical or mental incapacity to receive the survivor's benefit.

   (3) Where the person entitled to receive a survivor's benefit is a child under the age of 16 years, the survivor's benefit shall be paid to the parent or guardian having care of that child.

   (4) Where the person entitled to receive a survivor's benefit is an adult who is unable by reason of physical or mental incapacity to deal with one's affairs, the survivor's benefit shall be paid to an individual appointed to exercise any right to which the person may be entitled.

 

24.   Family member

   (1) The Authority shall pay a family funeral grant to a family member on the death of the member's registered spouse or children and dependants.

   (2) For purposes of this regulation, "family member" means a deceased member's surviving spouse in the absence of which shall mean the deceased member's child.

   (3) In the case of an unmarried deceased member, "family member" means the father or mother, brother or sister or any other person as the Authority may determine in consultation with the deceased's administrator or executor.

   (4) For purposes of this part, a member means-

   (a)   a contributing member who has made at least 12 months contributions or an equivalent of the annual minimum contribution applicable in that year in the last 36 months preceding the member's death; or

   (b)   a person in receipt of a retirement or invalidity pension.

 

25.   Family funeral grant of member

   (1) The Authority shall pay, on the death of a member, a family funeral grant provided that a member has made at least 12 monthly contributions or an equivalent of the annual minimum contribution applicable in that year in the last 36 months as provided under section 34 of the Act or, if, at the time of death, the deceased member was in receipt of a retirement or invalidity pension.

   (2) The Authority shall pay a family funeral grant to a contributing member on the death of a registered spouse or registered child or dependant below the age of 18, or below the age of 25 if in full time instruction in an educational institution.

 

26.   Computation of family funeral grant

   (1) The amount of the family funeral grant payable on the death of a member or registered spouse is 20 per cent of the prevailing funeral grant under the Act.

   (2) The amount of the family funeral grant payable on the death of a contributing members"™ registered child or dependant shall be 10 per cent of the prevailing funeral grant under the Act.

   (3) The family funeral grant payable to a member on the death of a family member shall be up to a maximum of six family members.

 

27.   Payment and adjustment of pension

   (1) Any pension payable under these Regulations shall be paid monthly from the date the beneficiary becomes eligible.

   (2) A pension shall cease in the month in which the beneficiary's entitlements cease or in the month following the month in which the beneficiary dies if that beneficiary remains entitled.

 

28.   Payment to a person residing abroad

The Authority may pay a benefit to a person abroad or on behalf of a person residing abroad who is eligible to a benefit under these Regulations.

 

29.   Responsibility of the Authority and beneficiary

   (1) The Authority shall notify a pensioner of the responsibilities arising under the Act and these Regulations as follows-

   (a)   when the determination is that a claimant is entitled to a survivor's pension;

   (b)   the amount of the benefit.

   (2) When the award is an invalidity pension, the beneficiary shall-

   (a)   notify the Authority immediately of any improvement in a pensioner's impairment that would allow engagement in substantially gainful employment;

   (b)   report earnings to the Authority within 14 days of their receipt of the earnings.

   (3) The award is the survivors benefit-

   (a)   if the survivor is a spouse below the age of 45 years with a minor child or a spouse above 45 years and the requirement to notify the Authority within 14 days of remarriage;

   (b)   if the survivor is a child between 18 and 25 years of age receiving full time instruction at an educational institution and the requirement to inform the Authority on ceasing or completing that instruction within 14 days; and

   (c)   if the survivor is a child with a physical or mental incapacity, the guardian or other representative shall inform the Authority of the earnings and of any improvement in the capacity that would allow the child to engage in substantial gainful employment.

   (4) The Authority may enter into arrangements with external institutions for the better carrying out of these Regulations and to enhance benefits to members.

 

FIRST SCHEDULE

[Regulations 10, 11, 12, 13, 14, 16, 18, 20]

CALCULATION ON BENEFITS

 

1.   Retirement pension

The monthly retirement pension due to a member is calculated as follows-

   

   Where-

   "G" is the monthly pension

   "AIME" is the average indexed Monthly Earnings; and

   "M" is the number of months of pensionable self-employment.

 

2.   Minimum pension

The minimum monthly pension (Gm) for a member is calculated as follows-

   Where-

   

   MMP is the minimum monthly pension as provided in the Act,

   Gm is the minimum monthly pension for members,

   NAE is National Average Earnings,

   Where G<<Gm,Gm is the monthly pension payable.

 

3.   Average indexed monthly earnings

For the purpose of these Regulations Average Indexed earnings are calculated by adding a member's indexed monthly earnings over the entire period of contribution and dividing them by the total number of months of contribution.

 

4.   Average indexed yearly earnings

The index (I) applied to arrive at the indexed earnings under sub-regulation (2) are determined as follows-

   

   Where-

   Qn is the national average earnings figure applicable in the year in which the member retires;

   Qm is the national average earnings figure applicable each year of the members service period from the year m = 1 to m = j where j is the year preceding the year for Qn.

 

5.   Early retirement pension

The early retirement benefit due to an eligible member is calculated as follows-

   P=G0.005 (M) G

   Where-

   "P" is the early retirement pension;

   "G" is the monthly pension;

   "M" is the number of months between a member's date of retirement and the attainment of the age of 55.

 

6.   Invalidity pension

   (1) The invalidity pension due to a member is calculated as follows-

   P=C+ MAX (G, Gm)

   "P" is the monthly rate of the invalidity pension to be determined for the member;

   "C" is the compensation for the lost years, equal to 0.005 (AIME)N where "AIME divided by 3" is the average indexed monthly earnings;

   Indexed Monthly Earnings and "N" is the number of years lost from work as a result of invalidity;

   "G" is the monthly pension;

   "Gm" is the minimum pension for a member; and

   "MAX(G,Gm)" is the greater of G and Gm.

   (2) The rate at which a member whose invalidity payment has been converted to a retirement benefit shall be paid as that of the member's invalidity payment or the retirement pension, whichever is greater.

 

7.   Retirement lump sum

   (1) A lump sum benefit payable to a member is calculated as follows-

   L=Sc+ 11 + 12 ...1n

   Where-

   L is the lump sum payable;

   Sc is the number of indexed monthly contributions;

   n is the number of months of pensionable self-employment; and

   "11, 12 .. .1n" is the total interest on the contributions made in the first, second and subsequent months of pensionable employment beginning with the month in which it is paid, through to the last month in which any contribution attracts interest and this being the last month before the month in which the lump sum is payable.

   (2) The calculation of the interest accumulated between the month in which the first contribution is made and the last month before the month in which the lump sum is payable shall be based on the following formula-

   Ii=cj(l+ij) (1 +ij+2)...(1 +im1)(1 +im)

   Where-

   "Ii" is the total interest on contributions made in the ith month beginning with the month in which it is paid continuing to the final month in which interest accrues;

   "cj" is the raw contribution rate for the ith month;

   "ij" is the nominal monthly interest charge for the jth month beginning with the ith month continuing to the mth month;

   "im" is the nominal monthly interest charge for the mth month which is the final month in which interest accrues.

 

8.   -

The available sum on a deceased member's earnings record is-

   (a)   if the deceased member was receiving a pension on the date of death, the amount of the member's monthly entitlement at the time of death; or

   (b)   if the deceased member was not receiving a pension on the date of death, and if that member was-

      (i)   of pensionable age, the monthly retirement pension for which the member was eligible at the time of death; or

      (iii)   not of pensionable age, the monthly invalidity pension computed as though the member was disabled using the date of death as the date of onset of the invalidity.

 

9.   -

   (1) The available sum on a deceased member's Survivor's earnings record is divided into shares by pension or lump sum employing the formula dependent-

   N=P1+P2+P3+P4+P5+P6 shares

   Where-

   "N" is the number of available shares

   "P1" is the number of all surviving spouses including pregnant spouses multiplied by two;

   "P2" is the number of surviving children under the age of 18;

   "P3" is the number of surviving children below the age of 25 who are receiving full time instructions at an educational institution;

   "P4" is the number of pregnant surviving spouses;

   "PS" is the number of non-surviving spouses with at least one minor child by the deceased;

   "P6" is the number of children of the deceased of any age who are either physically or mentally incapacitated both by the age of 18 and the death of the member.
