This Order may be cited as the Higher Education Loans and Scholarships Act (Commencement) Order, 2017.
2. Commencement of Act No. 31 of 2016
The Higher Education Loans and Scholarships Act, 2016, shall come into operation on the date of publication of this Order.

These Regulations may be cited as the Higher Education Loans and Scholarships (Transfer of Staff) Regulations, 2020.
(1) On commencement of these Regulations, a public officer from the Bursaries Committee shall be transferred to the Board on terms and conditions that the Board shall determine.
(2) Where a public officer is transferred under sub-regulation (1), the terms and conditions of that public officer with the Board shall be no less favourable than those applicable while in the public service, and for the purposes of determining rights to, or eligibility for, any pension, gratuity, leave or other benefits, the pensionable service of that public officer with the public service shall be treated as continuous service.
(3) Despite sub-regulation (1), a public officer from the Bursaries Committee-
(a) who is employed on contract and does not wish to be transferred to the Board, shall terminate their employment according to the terms and conditions of the contract; or
(b) who is on permanent and pensionable terms and does not wish to be transferred to the Board shall be retained by the Government and shall be redeployed in the public service.
