The areas described in the Schedule hereto are declared a Local Forest, to be known collectively as Local Forest No. P298: Amenshi.

 

SCHEDULE

CHIKOSHO MUSHITU

Starting at a point on the Chikosho Stream, approximately 2,800 metres from the confluence of the Chikosho Stream and the Katukuta River, the mushitu extends up the Chikosho Stream for a distance of 2,400 metres on either side of the stream.

CHILEMBA MUSHITU

Starting at a point on the Chilemba Stream, approximately 3,500 metres from the confluence of the Chilemba Stream and the Lukupa River, the mushitu extends up the Chilemba Stream for a distance of 2,700 metres, on either side of the stream, and includes an unnamed branch of the mushitu which extends North-Eastwards for a distance of 800 metres.

KABUMBA MUSHITU

Starting at a point on the Kabumba Stream, approximately 800 metres from the confluence of the Kabumba Stream and the Kapele Stream, the mushitu extends up the Kabumba Stream for a distance of 2,200 metres on either side of that stream.

KABUNDI MUSHITU

Starting at a point on the Kabundi Stream, approximately 1,200 metres from the confluence of Kabundi Stream and the Lukupa River, the mushitu extends up the Kabundi Stream for a distance of 3,300 metres on either side of the stream.

KAMILENGE MUSHITU

Starting at a point on the Kamilenge Stream, approximately 700 metres from the confluence of the Kamilenge Stream and the Lukupa River, the mushitu extends up the Kamilenge Stream for a distance of 6,300 metres on either side of the stream; and from a point 700 metres further up the Kamilenge Stream for a distance of 2,000 metres up that stream on either side of the stream.

KAPUMULA MUSHITU

Starting at a point on the Kapumula Stream, approximately 700 metres from the confluence of the Kapumula Stream and the Mulilansolo Stream, the mushitu extends up the Kapumula Stream for a distance of 2,200 metres on either side of that stream.

MANANGA MUSHITU

Starting at a point on the Mananga Stream, approximately 4,700 metres from the confluence of the Mananga Stream and the Mwanga Stream, the mushitu extends up the Mananga Stream for a distance of 1,800 metres on either side of that stream.

MIFINSA MUSHITU

Starting at a point on the bank of the Lukupa River, approximately 1,300 metres from the crossing of road RD.30, the mushitu extends northwards for a distance of 600 metres on either side of the river.

MILENGE MUSHITU

Starting at a point on the Milenge Stream, approximately 1,300 metres from the confluence of the Milenge Stream and the Kamilenge Stream, the mushitu extends up the Milenge Stream for a distance of 3,500 metres on either side of that stream; and from a point 600 metres up the Milenge Stream for a distance of 1,900 metres on either side of that stream.

MILIMA MUSHITU

Starting at a point on the Milima Stream, approximately 2,500 metres from the confluence of the Milima Stream and the Lukupa River, the mushitu extends up the Milima Stream for a distance of 6,000 metres on either side of the stream.

MILUNGU MUSHITU

Starting at a point on the Milungu Stream, approximately 1,300 metres from the confluence of the Milungu Stream and the Lukupa River, the mushitu extends up the Milungu Stream for a distance of 4,000 metres on either side of the stream.

MIYONGOLO MUSHITU

Starting at a point on the Miyongolo Stream, approximately 1,000 metres from the confluence of the Miyongolo Stream and the Lukupa River, the mushitu extends up the Miyongolo Stream for a distance of 2,700 metres on either side of the stream.

MULILANSOLO MUSHITU

Starting at a point on the Mulilansolo Stream, approximately 600 metres from the confluence of the Mulilansolo Stream and the Kapumula Stream, the mushitu extends up the Mulilansolo Stream for a distance of 1,000 metres on either side of that stream.

MWANGA MUSHITU

Starting at a point on the Mwanga Stream, approximately 4,000 metres from the confluence of the Mwanga Stream and the Kapele Stream, the mushitu extends up the Mwanga Stream for a distance of 1,500 metres on either side of that stream.

2.   Interpretation

   (1) In this Order, unless the context otherwise requires "œcharcoal" means the black product of a tree log burnt in an oven and used as fuel.

   (2) For the purposes of this Order, an offence under this Order shall be a forest offence under the Act.

 

3.   Prohibition of exportation of charcoal

   (1) A person shall not export from Zambia any charcoal, either manufactured from a plantation or obtained from a Local Forest or National Forest or a forest which naturally grows or regenerates in a particular area.

   (2) A person who contravenes sub-section (1) commits an offence.

 

4.   Unlawful possession of charcoal

Any person who receives, is in possession of, or deals in any manner in, charcoal which is unlawfully obtained or in respect of which offence has been committed commits an offence.

 

5.   Penalty

Any person who commits an offence under this Order shall be liable, upon conviction, to a fine not exceeding two thousand penalty units or to imprisonment for a period not exceeding one year, or to both.

These Regulations may be cited as the Local Forests (Control and Management) Regulations, 2006.

 

2.   Interpretation

These Regulations, unless the context otherwise requires"“

"œarea" means an area declared a Joint Forest Management Area under these Regulations;

"œDepartment" means the Forestry Department;

"œForest Committee" means the Forest Management Committee established under these Regulations;

"œJoint Forest Management Area" means an area declared as such under Regulation 3;

"œLocal community" means residents within or adjacent to a declared Joint Forest Management Area, who by virtue of their rights over land, invest in and derived benefits from sustainable management and Utilisation of forest resources in their area;

"œuser group" means individuals or groups involved in one common activity in an area and bound by a common agreement or constitution; and

"œVillage committee" means a Village Resource Management Committee established under these Regulations.

 

3.   Declaration of Joint Forest Management Area

The forest area listed in the Schedule to these Regulations are hereby declared Joint Forest Management Areas for the purpose of their control and management.

 

4.   Forest Management Committee

   (1) There shall be a Forest Management Committee for each area which shall comprise of the following members:

   (a)   one representative of each chief in the area appointed by the Chief;

   (b)   one representative of the Forest Department at district level;

   (c)   one representative of each Village Committee in the area elected by the respective Village Committee; and

   (d)   one representative of the District Council.

   (2) The members of the Forest Committee shall elect from amongst themselves, a Chairperson, a Secretary and a Treasurer.

   (3) The Forest Committee shall regulate its own procedure.

   (4) A member of the Forest Committee shall hold office for such term as shall be stipulated by the constitution of the area.

 

5.   Functions of Forests Committee

The Forest Committee shall"“

   (a)   develop and manage the area;

   (b)   implement the Joint Forest Management Plan for the Joint Forest Management Area;

   (c)   appoint forestry reserve guards and issue identity cards to such forestry reserve guards;

   (d)   share benefits derived from within their area in accordance with the Joint Forest Management Plan; and

   (e)   advise the Chief Conservator of Forest concerning prices at which firewood, poles, minor forest products and other forest produce may be sold.

 

6.   Village Resource Management Committee

   (1) There shall be constituted in each area such number of village resource management committees as may be determined by the Department in consultation with village headmen in the area.

   (2) A village Committee shall comprise of the following:

   (a)   a forestry officer;

   (b)   the village headmen of villages in the Area;

   (c)   one representative of the honorary forest officers from the area; and

   (d)   one representative from each user group in the area.

   (3) A village Committee shall"“

   (a)   advise the forestry officer concerning the issue of licences in respect of forestry produce in their area;

   (b)   elect members of the Forest Management Committee;

   (c)   nominate persons for appointment as honorary forest officers;

   (d)   prepare and submit work plans to the Forest Committee; and

   (e)   prepare and submit progress reports to the Forest Committee.

   (4) The Forest Department shall facilitate the constitution of a Village Committee.

   (5) The members of the Village Committee shall elect the Chairperson, Secretary and Treasurer from amongst themselves.

   (6) The Village Committee shall regulate its own procedure.

   (7) The member of a Village Committee shall hold office for such term as shall be stipulated by the constitution of the area.

   (8) The Village Committee may invite any other person to take part in a meeting but such person shall not vote.

   (9) A member of a Village Committee shall be removed in accordance with the provisions of the constitution for the area.

 

7.   Registration of Forest Trust for Area

A local community shall, where a Forest Committee and Village Committees have been formed for the area, register the group as a Forest Trust for the area with the Registrar of Societies under the Societies Act.

 

8.   Joint Forest Management Plan

   (1) A forest Committee shall prepare a management plan for the area according to the guidelines stipulated by the Department.

   (2) The Department shall cause a notice of the completion of a management plan to be published in a newspaper of general circulation in Zambia.

   (3) A notice published under sub-regulation (2) shall State the time and place at which the management plan may be inspected by members of the public and shall request for objections in writing to be lodged with the Department within 30 days from the date of publication of the notice.

   (4) A management plan shall, where no objections have been lodged with the Department be legally binding after 30 days from the date of notice.

   (5) The Department shall hear and determine any objection lodged and shall cause the decision to be published in a newspaper of general circulation in the Republic of Zambia.

 

9.   Application and approval of licences

   (1) A forestry officer may reject an application if"“

   (a)   it is not in the interest of the local community to issue a licence;

   (b)   the issue of the licence does not comply with the Joint Forest Management Plan;

   (c)   the applicant has failed to provide all the information required, on the application form;

   (d)   the applicant does not produce upon request by an authorised person, a national registration card, passport or any other form of recognised identity; or

   (e)   payment is not made in full.

 

10.   Appeals

   (1) A person aggrieved by a decision of the Village Committee taken under paragraph (b) or (c) of sub-regulation (3) of Regulation 6 may appeal to the Forest Committee.

   (2) Where a person appeals to the Forest Committee but is not satisfied with its decision that person may appeal to the Provincial Forestry Office.

 

11.   Restriction on the removal of forest products

A person shall not harvest or remove any forest produce from an area without a licence issued by a forest officer under these Regulations.

 

12.   Revocation of S.I. No. 52 of 1999

The Forests (Control and Management) Regulations, 1999 are hereby revoked.

1.   Title

These Regulations may be cited as the Forests (Export of Timber) Regulations, 2015.

 

2.   Interpretation

In these Regulations unless the context otherwise requires—

"Concession licence" has the meaning assigned to it in the Act;

"exporter" means a holder of a concession licence or timber merchant who exports forest produce;

"finished timber products" means timber products which have been processed and are in component pieces;

"forest officer" has the meaning assigned to it in the Act;

"inspector" has the meaning assigned to it in the Standards Act;

"letter" means a letter of credit;

"permit" means a forest produce export permit issued under these Regulations;

"plantation" has the meaning assigned to it in the Act;

"plantation tree" means a tree from a plantation;

"planted species" means cultivated trees;

"quota" meant the maximum volume of timber which an exporter may export at a time, calculated as a percentage of the total production;

"sawn timber" means timber which has been sawn by a sawmill or pitsaw in accordance with a customer"™s specifications;

"timber" has the meaning assigned to it in the Act;

"timber merchant" means a person who buys and sells timber or timber products but does not hold a concession licence; and

"timber products" means sawn timber and includes cant wood with cross ends of selected timber species and finished timber products.

 

3.   Timber eligible for export

   (1) Subject to these Regulations, the following timber may be exported—

   (a)   sawn timber;

   (b)   railway sleepers which shall be drilled on both sides;

   (c)   poles from planted species;

   (d)   finished timber products; or

   (e)   plantation trees.

   (2) Despite sub-regulation (1), the Director may grant a permit for the export of any other timber the Director may, in consultation with the Minister, consider necessary in the interest of the Republic.

   (3) An exporter shall not export any of the following—

   (a)   charcoal;

   (b)   non-finished timber products from national forests; and

   (c)   peelers and saw logs of any species.

 

4.   Restriction on use of species of timber

A person shall not use any of the following species of timber to manufacture railway sleepers—

   (a)   Afzelia quanzensis (Mupapa);

   (b)   Entandrophragma spp.(Mofu);

   (c)   Faurea Saligna (Saninga);

   (d)   Guibourtia coleosperma (Muzauli);

   (e)   Khaya nyasica (Mululu);

   (f)   Pericopsis angolensis (Mubanga);

   (g)   Pterocarpus angolensis (Mukwa); and

   (h)   Pterocarpus chrysothrix (Mukula).

 

5.   Application for permit

   (1) Subject to sub-regulation (3), a holder of a concession licence or timber merchant may apply to the Director for a permit in Form I set out in the Schedule.

   (2) The Director shall, within 30 days of the receipt of an application, notify the applicant of the decision of the Director in respect of the application.

   (3) Notwithstanding sub-regulation (1), a timber merchant who does not have a written agreement with a holder of a concession licence authorising the timber merchant to export timber of the concession licence is not eligible to apply for a permit.

 

6.   Rejection of application for permit

   (1) The Director shall reject an application for a permit if—

   (a)   the applicant fails to meet the requirements of the Act;

   (b)   the permit issued to the applicant was cancelled by the Director; or

   (c)   the applicant is convicted of an offence under the Act or any other written law.

   (2) The Director shall, where the Director rejects an application under sub-regulation (1), inform the applicant of the reasons for the rejection in Form II set out in the Schedule.

 

7.   Issuance of permit

   (1) The Director shall, where the applicant meets the requirements of the Act, issue a permit in Form III set out in the Schedule.

   (2) A permit shall be valid for six months from the date of issue.

 

8.   Application for renewal of permit

   (1) An application for the renewal of a permit shall be made to the Director in Form IV set out in the Schedule at least three months before the expiry of the permit.

   (2) The Director may within 30 days of receipt of an application for the renewal of a permit, renew the permit if the applicant meets the requirements of the Act and has complied with the terms and conditions of the permit.

   (3) The Director shall, where the Director renews a permit, endorse the renewal on the permit.

   (4) A permit that is not renewed by the Director lapses on its date of expiry.

 

9.   Application for duplicate permit

A holder of a permit may, where a permit is lost, damaged or defaced, apply to the Director for a duplicate permit in Form V set out in the Schedule.

 

10.   Suspension or cancellation of permit

   (1) The Director may suspend or cancel a permit if the holder—

   (a)   obtained the permit by fraud or deliberate or negligent submission of false information or statements; or

   (b)   contravenes any terms and conditions of the permit or the Act.

   (2) The Director shall, before suspending or cancelling a permit, notify the holder in writing of the intention to suspend or cancel the permit specifying the reasons for the intended suspension or cancellation of the permit and require the holder to show cause, within a period of thirty days, why the permit should not be suspended or cancelled.

   (3) A notice of intention to suspend or cancel a permit shall be in Form VI set out in the Schedule.

   (4) The Director shall suspend a permit if the holder of the permit fails to take remedial measures within the period specified in the notice issued under sub-regulation (2).

   (5) A notice of the suspension or cancellation of a permit shall be in Form VII set out in the Schedule.

 

11.   Register of permits

   (1) The Department shall keep and maintain a register of permits in Form VIII set out in the Schedule.

   (2) The register referred to in sub-regulation (1) shall be kept at the offices of the Department and shall be open to inspection by the public at such times and upon payment of an inspection fee determined by the Director.

 

12.   Restriction on quantities of timber to be exported

   (1) Subject to sub-regulation (2), an exporter who is a holder of a concession licence shall not export more than seventy-five percent of the timber produced by such exports.

   (2) Sub-regulation (1) does not apply to the export of—

   (a)   planted species; or

   (b)   finished timber products.

   (3) For purposes of sub-regulation (1), timber exported by a timber merchant under an agreement referred to in regulation 5(3) shall be included in the export quota of the exporter who is a holder of a concession licence.

 

13.   Clearance before export

A forest officer shall—

   (a)   mark timber produce before it is exported; and

   (b)   issue a clearance certificate in Form IX set out in the Schedule.

 

14.   Inspection before export

A forest officer, a police officer or an inspector shall inspect a consignment of timber intended for export, in order to ascertain that—

   (a)   the timber matched the order submitted by the buyer;

   (b)   the timber procured has been procured in accordance with the provisions of the Act;

   (c)   the timber bears an export mark; and

   (d)   is accompanied by documents from the area of origin.

 

15.   Export procedure

   (1) An exporter shall not export timber unless that exporter has received a confirmed order for the export of the timber specifying the desired timber and the quantity required.

   (2) The exporter shall issue to the buyer a quotation stating—

   (a)   the price, either free on board, or cost insurance and freight, of the timber;

   (b)   the quantity of the timber; and

   (c)   the quality of the timber.

   (3) The exporter shall, when requested to do so by the buyer, send to the buyer, a sample of the specified forest produce to be exported.

   (4) The exporter shall issue a proforma invoice, when the buyer accepts the quotation, stating the—

   (a)   timber specification;

   (b)   quantity of the timber;

   (c)   price of the timber;

   (d)   delivered term of the timber;

   (e)   receiving bank; and

   (f)   validity of the offer.

   (5) The buyer shall open an irrevocable confirmed letter or use a telegraphic transfer of funds through the exporter"™s bank.

   (6) The exporter"™s bank shall advise the supplier when an irrevocable letter or a telegraphic transfer of funds is received.

   (7) The exporter"™s bank shall issue an export declaration form comprising the—

   (a)   permit;

   (b)   customs bill of entry; and

   (c)   customs declaration.

   (8) The exporter shall submit the export declaration form accompanied by the following documents to a customs official—

   (a)   a commercial invoice;

   (b)   a packing list;

   (c)   shipping consignment notes;

   (d)   timber export permit;

   (e)   a written agreement (where applicable);

   (f)   records of production (where applicable); and

   (g)   clearance certificate.

   (9) An exporter shall only ship the export timber upon completion of the formalities referred to in sub-regulation (1) to (8).

   (10) The exporter shall present the documents listed in sub-regulation (8) to the exporter"™s banker for payment on—

   (a)   completion of all export formalities; and

   (b)   receipt of the export timber by the buyer.

 

16.   Inspection by customs officer

A customs officer shall—

   (a)   inspect the consignment of timber to be exported and the clearance certificate at the port of exit;

   (b)   verify whether or not the details on the clearance certificate match the consignment of timber; and

   (c)   endorse the clearance certificate with the appropriate results of such inspection.

 

17.   Revocation of S.I. No. 7 of 1997 and transitional provisions

   (1) The Forests (Timber Export) Regulation,1997 are revoked.

   (2) Despite sub-regulation (1), a licence issued under the revoked regulations shall remain valid until its expiration or revocation.

1.   Title

These Regulations may be cited as the Forest (Concession Licence) Regulations, 2016.

 

2.   Interpretation

In these Regulations, unless the context otherwise requires—

"cant" means a partially sawn log with at least four flat sides;

"commencement date" means the effective date of the licence;

"compartment" means a sub-division of a concession area measuring between 85 to 200 hectares in extent, where boundaries are clearly demarcated by blazing, clearing or use of natural features;

"concession area" means a forest area in respect of which a licence is issued;

"Department" has the meaning assigned to it in the Act;

"Director" has the meaning assigned to it in the Act;

"ecologically sensitive" means a fragile ecosystem such as a headwater, water catchment area or high and sloppy gradient;

"environmental impact assessment" has the meaning assigned to it in the Environmental Management Act, 2011;

"equipment" means a licensee"™s machinery and vehicles brought temporarily to the licensee"™s concession area for purposes of cutting, felling, Transporting or processing timber;

"forest officer" means a senior forest officer, forest officer or any other officer authorised by the Director;

"hammer mark" means the mark made by a registered timber marking hammer;

"licence" means a concession licence issued under section 52 of the Act;

"licensee" means a holder of a licence;

"over-bark diameter" means the diameter of a log including the bark measured at the mid point of the log;

"plan of operations" means the plan prepared by a licensee setting out the programme of work to be done in a particular year;

"round wood" means timber used or moved without being squared by sawing or hewing;

"saw log" means the straight or crooked part of a tree stem to be processed at a sawmill;

"sawn timber" means timber which has been sawn by a sawmill or pitsaw in accordance with a customer"™s specifications;

"senior forest officer" means the Director, Chief Forest Officer or Principal Forest Officer;

"stocking" means the quantitative measure of timber expressed as stems per hectare, basal area per hectare or volume per hectare in a potential concession area to support timber production;

"timber-marking hammer" means a registered steel hammer bearing a specific number and held in trust by a forest officer;

"timber-processing" means peeling-off the bark, removing timber wane, cross cutting and sawing of logs into various shapes and timber dimensions or sizes; and

"Zambia Environmental Management Agency" has the meaning assigned to it in the Environmental Management Act, 2011.

 

3.   Forest areas eligible for licences

   (1) Subject to these Regulations, a licence may be issued in—

   (a)   a National Forest;

   (b)   a Local Forest;

   (c)   an open area;

   (d)   a community forest;

   (e)   a private forest; and

   (f)   a joint forest management area.

   (2) Despite sub-regulation (1), the Director shall not issue a licence in a forest area that is ecologically sensitive.

 

4.   Identification and advertisement of concession areas

   (1) The Director shall cause the following to be undertaken in forest areas—

   (a)   identification of potential concession areas;

   (b)   production of maps of identified potential concession areas; and

   (c)   a pre-harvesting inventory to determine stocking in a potential concession area.

   (2) The Director shall advertise the identified potential concession areas in at least two daily newspapers of wide circulation in Zambia.

 

5.   Cutting, felling and processing of timber under licence

The Director may issue a licence in respect of the following—

   (a)   large scale cutting, felling or processing of timber;

   (b)   medium scale cutting, felling or processing of timber; and

   (c)   small scale cutting, felling or processing of timber.

 

6.   Application for licence

   (1) A citizen may apply to the Director for a licence in Form I set out in the First Schedule.

   (2) An application for a licence shall be accompanied by—

   (a)   letters signifying the consent of the chief and the local authority in the concession area, to the grant of the licence to the applicant;

   (b)   decision letter issued to the applicant by the Zambia Environmental Management Agency regarding the environmental impact assessment undertaken by the applicant in respect of the proposed concession area applied for; and

   (c)   a forest management and regeneration plan.

   (3) The Director shall, in determining whether or not to issue a licence, have regard to—

   (a)   the resources available and quantity of timber that the applicant proposes to cut, fell or process;

   (b)   any comments or presentation from the local community in the area where the proposed concession area is located who are likely to be affected by the grant of the licence;

   (c)   the quality and feasibility of the forest management and re-generation plan;

   (d)   the social and economic contribution of the licensee to the local community and employment creation commitments; and

   (e)   the equipment and proposed investment levels.

   (4) The Director may request for further particulars or information in Form II set out in the First Schedule.

 

7.   Rejection of application for licence

The Director shall, within 30 days of receipt of an application for a licence, reject the application if the applicant does not meet the requirements of the Act and inform the applicant of the rejection in Form III set out in the First Schedule.

 

8.   Issue of licence

   (1) The Director shall, within 30 days of receipt of an application for a licence, issue the licence to the applicant if the applicant meets the requirements of the Act.

   (2) A licence shall be in Form IV set out in the First Schedule.

   (3) A licence shall be valid for—

   (a)   five years, for large scale cutting, felling or processing;

   (b)   three years, for medium scale cutting, felling or processing; and

   (c)   two years, for small scale cutting, felling or processing.

 

9.   Application for duplicate licence

A licensee may, where a licence is lost, damaged or defaced, apply to the Director for a duplicate licence in Form V set out in the First Schedule.

 

10.   Application for renewal of licence

   (1) An application for the renewal of a licence shall be made to the Director in Form VI set out in the First Schedule at least 90 days before the expiry of the licence.

   (2) The Director may, within 30 days of receipt of an application for the renewal of a licence, renew the licence if the applicant meets the requirements of the Act and has complied with the terms and conditions of the licence.

   (3) A licence that is not renewed lapses on its date of expiry.

 

11.   Restriction on transfer of licence

A licensee shall not assign, cede or transfer the licence to any other person.

 

12.   Suspension or cancellation of licence

   (1) The Director may suspend or cancel a licence if the licensee—

   (a)   contravenes the Act;

   (b)   contravenes any terms and conditions of the licence;

   (c)   submitted false or misleading information in the application for the licence;

   (d)   stops operating for 30 days without the written authorisation of a senior forest officer; or

   (e)   does not take remedial measures to correct defects notified to the licensee by a forest officer within 14 days of being notified of the defect.

   (2) The Director shall, before suspending or cancelling a licence, notify the licensee of the intention to suspend or cancel the licence and request the licensee to show cause, within 30 days from the date of the request, why the licence should not be suspended or cancelled.

   (3) A notice of intention to suspend or cancel a licence shall be in Form VII set out in the First Schedule.

   (4) The Director shall suspend or cancel a licence if the licensee does not take remedial measures within the period specified in the notice issued under sub-regulation (2).

   (5) A notice of suspension or cancellation of a licence shall be in Form VIII set out in the First Schedule.

   (6) Where a licence is suspended or cancelled, the licensee shall cease operations immediately.

 

13.   Rights of licensee

A licensee may, with the permission of a senior forest officer—

   (a)   establish and operate log depots, timber depots, storerooms, workshop, offices and garages;

   (b)   construct temporary buildings, including dwelling houses for the licensee and the licensee"™s employees;

   (c)   sink boreholes, make dams, dig wells and install water supply reticulations;

   (d)   construct and maintain roads, ridges, bridges, culverts, embarkments and other ancillary;

   (e)   take stone, gravel and sand for constructing or maintaining roads and buildings in the concession area; or

   (f)   erect and maintain telephone lines and other means of communication.

 

14.   Plan of operation

   (1) A licensee shall, during the month of October of every year in which the licence remains in force, submit to a senior forest officer a plan of operations specifying the work to be carried out by the licensee in the following year.

   (2) The plan of operations shall contain the following information—

   (a)   the compartment to be exploited and the order in which the compartment is to be exploited;

   (b)   the tree species and quantities to be removed from each compartment;

   (c)   the roads to be constructed or used; and

   (d)   the sites of log depots and main camps to be used.

   (3) A licensee who intends to amend the plan of operations shall apply to a senior forest officer for approval.

   (4) A senior forest officer shall, where the senior forest officer rejects the proposed amendments to the plan of operations, inform the licensee accordingly and give reasons for the rejection.

 

15.   Safety

A licensee shall be responsible for the safety of the approved activities in the operation area.

 

16.   Discoveries

   (1) A licensee shall, where the licensee in the course of exercising the rights under the licence discovers anything of historical or other interest or of significant value in the concession area, notify the Director of the discovery and the circumstances of the discovery within 30 days of such discovery.

   (2) A thing discovered under sub-regulation (1) is the property of the Government.

 

17.   Felling

   (1) A licensee shall fell all trees at a maximum height of 0.30 metres above the ground.

   (2) A licensee shall, unless authorised in writing by a senior forest officer, fell trees in only one compartment at a time.

   (3) A licensee shall fell any tree containing sawn log.

   (4) A licensee shall not fell any tree—

   (a)   whose diameter over bark at one point three metres (1.3 m) above ground level is less than 30 centimetres; or

   (b)   marked by a senior forest officer as a tree that shall not be felled.

 

18.   Demarcation of boundaries

   (1) A licensee shall demarcate, at the licensee"™s expense, the boundaries of compartments intended to be worked in, but as far as possible, shall ensure the use of natural features as boundaries.

   (2) A licensee may use cleared or blazed lines as boundaries.

 

19.   Fire prevention

   (1) A licensee shall take necessary steps to prevent fires and shall maintain fire-breaks and undertake early burning of areas in which the licensee is operating or intends to operate according to the plan of operations.

   (2) A forest officer or licensee who intends to carry out early burning operations in a concession area shall give notice of at least two weeks to the other party.

 

20.   Register of licences

   (1) The Department shall keep and maintain a register of licences in Form IX set out in the First Schedule.

   (2) The register referred to in sub-regulation (1) shall be kept at the offices of the Department and shall be open to inspection by the public at such times and upon payment of the prescribed inspection fee.

 

21.   Fees

The fees set out in the Second Schedule are prescribed for the matters specified in that Schedule.

TERMS AND CONDITIONS OF CONCESSION LICENCE

PART I
GENERAL OBLIGATIONS

1.   Instructions

   A licensee shall comply with all lawful instructions of the Senior Forest Officer concerning the cutting, felling and processing of the timber.

2.   Personnel

   2.1.   A licensee shall employ, among the key personnel, a qualified forester or other personnel approved by the Senior Forest Officer, to supervise all the site works related to felling.

   2.2.   The Senior Forest Officer shall approve any proposed replacement of the key personnel if their qualifications and abilities are substantially equal to or better than those of the personnel to be replaced.

   2.3.   The Director or the Senior Forest Officer may direct the licensee to ensure that any personnel in the concession area who contravenes the provisions of the Act or breaches the terms and conditions of the licence, leaves the concession area within fourteen days from the date of the direction.

3.   Communication

   3.1.   Communications between the licensee and any other representative of the Forestry Department that are referred to in the conditions shall be effective only when in writing.

   3.2.   A notice shall be effective when it is delivered and received by either party.

4.   Production

   4.1.   A licensee shall commence the approved activities on the agreed commencement date and shall carry out the necessary works in accordance with the plan of operations submitted by the licensee and approved by the forest officer, and complete them by the intended completion date.

   4.2.   A licensee shall, from the commencement date, pay for tree felling as follows—

      (a)   a maximum of one hundred cubic metres of timber for small scale;

      (b)   a maximum of two hundred cubic metres of timber for medium scale; and

      (c)   a maximum of four hundred cubic metres of timber per one calendar month for large scale.

   4.3.   A licensee shall pay for branch-wood at 200 fee units per cubic metre.

PART II
CONDUCT OF OPERATIONS

5.   Operational Record

   5.1.   A licensee shall measure and record every timber log removed from a compartment and the forest officer shall mark on one end of each log with a timber marking hammer.

   5.2.   Every log shall be measured mid-length diameter in centimetres and its length in metres and tenths of a metre and volume calculated using the Huber's formula.

   5.3.   On the 5th day of every month, a licensee shall submit returns of the logging operations of the previous month to the Senior Forest Officer showing the number of trees, volume and number of logs by tree species removed from the compartment.

   5.4.   All sawn timber shall be hammer marked by a forest officer before removal from a felling site.

   5.5.   Movement of round-logs is only permitted within a distance of 100 km.

   5.6.   A forest produce conveyance permit shall be obtained for the movement of round-logs within 100 km to the processing facility.

6.   Co-operation

   6.1.   A licensee shall co-operate with other licensees in the concession area.

   6.2.   The Director or Senior Forest Officer shall notify a licensee of the presence of the other licensees in the concession area.

PART III
FEES

7.   Payment of Fees

   7.1.   All tree felling permits shall be paid for before cutting commences, and no credit facilities or carry over will be permitted.

   7.2.   Payment in respect of penalties shall be made within thirty days of the date on which the penalty is imposed.

PART IV
DISPUTES

8.   Dispute

   8.1.   A licensee who is aggrieved with the decision of the forest officer may appeal to the Director within thirty days of the receipt of the forest officer"™s decision.

   8.2.   The Director shall give a decision, in writing, within thirty days of receipt of notification of a dispute.

9.   Early Warning

   A licensee shall inform the forest officer at the earliest opportunity of any event that may adversely affect or delay the execution of the planned operations.

10.    Completion

   10.1.   The licensee shall request the Forest Officer to issue a certificate of completion at the expiration of the licence and the Forest Officer shall issue the certificates if the operations were carried out in accordance with the terms and conditions of the licence.

   10.2.   A licensee shall, within three months of the date of cancellation of the licence, remove all plant and equipment from the concession area, but shall not move any culverts, bridges or underground pipes.

SI 11 of 2018.

 

1.   Title

These Regulations may be cited as the Forests (Community Forest Management) Regulations.

 

2.   Interpretation

In these regulations, unless the context otherwise requires—

"œcommunity forest management group" has the meaning assigned to the words in the Act;

"œcommunity resource board" has the meaning assigned to the words in the Wildlife Act ;

"œDirector" means the person appointed as Director of Forestry under the Act;

"œlocal authority" has the meaning assigned to the words in the Local Government Act ;

"œmajor forest produce" has the meaning assigned to the words in the Act;

"œminor forest produce" has the meaning assigned to the words in the Act;

"œlocal forest" has the meaning assigned to the words in the Act; and

"œopen area" has the meaning assigned to the words in the Act.

 

3.   Promotion of community forest management areas

A local authority shall, for forests within the jurisdiction of that local authority, identify, support and encourage local communities to apply to the Director for control, use and management of areas of forests for purposes of social, cultural and economic needs.

 

4.   Forest areas eligible for community forest management

   (1) Subject to these Regulations, community forest management may be applied in—

   (a)   open areas;

   (b)   local forests; and

   (c)   game management areas.

   (2) Despite sub-regulation (1), the Director in consultation with the Minister may consider community forest management in any other type of forest.

   (3) An area proposed for community forest management shall be free of a forest concession or sawmilling licence.

 

5.   Members of community forest management group

A community forest management group shall consist of individuals who are citizens who reside in the community area and have resided in the area at least for two years.

 

6.   Application for recognition as a community forest management group

   (1) A community forest management group may apply to the Director for recognition in Form I set out in the schedule.

   (2) An application for recognition of a community forest management group shall require—

   (a)   prior consultations with local users and other right holders of the proposed forest; and

   (b)   the consent of local traditional leaders.

   (3) An application for recognition shall be accompanied by—

   (a)   a sketch map of the proposed location and area to be established as a community forest;

   (b)   community forest management group constitution including list of the elected representatives of the group;

   (c)   consent of the Chief of the area to recognise the applicants as a community forest management group through endorsement of the application or map signifying such consent; and

   (d)   a statement of intent for the proposed area indicating a balance between forest protection and management, development, utilisation and forest enterprise development in Form I set out in the Schedule.

   (4) The Director may request further information in Form II set out in the Schedule.

 

7.   Rejection of recognition of community forest management group

   (1) The Director shall reject an application for a community forest management group where the applicants fail to meet the requirements specified in the application form.

   (2) Where an application is rejected under sub-regulation (1), the Director shall notify the applicant of the reasons for the rejection in Form III set out in the Schedule.

 

8.   Recognition of community forest management group

   (1) The Director shall, where the applicants meet the requirements referred to in regulation 6, recognise a group as a community management group.

   (2) Where the Director fails to respond to an application for recognition of a forest management group within twenty-one days from the time it was lodged, the application shall be considered approved and the group recognised.

 

9.    Rights and responsibilities upon submission of an application for recognition of a community forest management group

   (1) The community forest management area shall be for the exclusive use of the local community represented by the community forest management group unless an application for recognition is rejected by the Director.

   (2) The Director shall, where a community forest management group is not recognised in accordance with regulation 8, not issue a licence or permit for a proposed community forest area.

   (3) The community forest management groups shall—

   (a)   protect and restrict access to the community forest area by persons not part of the community;

   (b)   control restricted activities within the identified community forest area; and

   (c)   report forestry related offences to the forest officer.

 

10.   Assessment of potential user rights

   (1) A recognised community forest management group shall carry out field appraisals and socio economic survey in the targeted community forest in order to conduct an assessment on the potential user rights by the community and other users of the targeted community forest.

   (2) The local authority and Director shall assist the community forest management group in conducting an assessment referred to in sub-regulation (1).

 

11.   Application for community forest agreement

   (1) A recognised community forest management group under regulation 8 shall within 90 days of recognition enter into a community forest agreement in Form IV set out in the Schedule.

   (2) The Director may revoke recognition of a community forest management group where an application has not been received within the period specified in Form IV.

   (3) An application to enter into a community forest management agreement shall be accompanied by—

   (a)   a community forest map showing the boundary of the community forest that has been consented to or signed by representatives of concerned neighbouring communities, Ward Development Committees, and the Chiefs within the area proposed for community forest management; and

   (b)   a community forest management plan which is in accordance with sustainable forest management principles that includes a set of community rules and measures that support proper management of the community forest.

   (4) The community forest agreement shall, specify the right to issue community permits and collect revenue for products specified in the community forest management plan.

   (5) The Director may request further information in Form II set out in the Schedule.

 

12.   Entry into or rejection of an application for community forest agreement

   The Director shall, within 60 days of receipt of an application under regulation 11, approve or reject an application for community forest agreement.

 

13.   Approval of application

Where the Director approves an application for community forest agreement, the approval shall be by notice in form VI set out in the Schedule.

 

14.   Rejection of application

Where the Director rejects an application for community forest agreement, the rejection shall be in Form III set out in the Schedule.

 

15.   Appeals

A group of persons aggrieved by the decision of the Director may—

   (a)   within thirty days from the date of receipt of the decision of the Director, appeal to the Minister responsible for forestry; and

   (b)   within thirty days from the date of receipt of the decision of the Minister, appeal to the High Court.

 

16.   Assistance with control of restricted activities

   (1) The community forest management groups shall assist the Director to control restricted activities within an established community forest area.

   (2) A recognised community forest management group shall select members to be appointed as Honorary forest officers in accordance with the Forests Act, 2015 .

 

17.   Assignment of rights under community forestry agreement

   (1) Where a community forestry management group intends to assign some or all of its rights under a community forestry agreement to any other person or group, the group shall apply to the Director for the transfer of rights in Form VII set out in the Schedule.

   (2) The person or group being assigned the rights shall be subjected to requirements of the approved community forest agreement and additional conditions specified in the Schedule.

   (3) The community forest management group and the persons to be assigned rights shall specify the benefits sharing arrangements.

   (4) The Director may request further information in Form II set out in Schedule.

 

18.   Entry into or rejection of an application for assignment of rights under a community forest agreement

The Director shall, within 60 days of the application approve or reject a request for assignment of rights under the community forest agreement.

1.   COMMUNITY FOREST MANAGEMENT GROUP RIGHTS

   (i)   In accordance with section 32 (2) of the Forests Act, 2015, the Director of Forestry confers on the community forest management group the following forest user rights in the community forest concerned:

   (ii)   In accordance with section 32 (2) (k) of the Forests Act, 2015, the Director of Forestry confers on the community forest management group all of the following other benefits in the community forest concerned:

      (a)   Subsistence use rights over forest products from within the community forest in accordance with sustainable forest management principles and management activities laid out in the approved management plan and local regulations.

      (b)   The right to issue community permits and collect revenue for those products and uses provided for in this Agreement.

      (c)   The right to mark such products with a marking instrument.

      (d)   The right to retain the revenues from fines or disposal of confiscated goods as a result of apprehensions of person(s) committing illegal acts within the community forest area based on the agreed community agreed rules and measures specified in Annex 2.

2.   COMMUNITY FOREST MANAGEMENT GROUP OBLIGATIONS

   (i)   The CFMG accepts and undertakes to protect, manage, control and utilise sustainably the forest resources in accordance with terms and conditions stipulated in this agreement and annexes attached thereof. Specifically, to:

      (a)   protect, conserve and manage the community forest or part thereof pursuant to the community forestry agreement and the management plan for the community forest;

      (b)   formulate and implement forest management consistent with traditional forest user rights of the local community in accordance with sustainable forest management;

      (c)   protect sacred groves and protected trees in the community forest;

      (d)   assist the Director in enforcing the provisions of the Forests Act, 2015, in relation to illegal harvesting of forest produce;

      (e)   with the approval of the Director, enter into partnerships with other persons for the purposes of ensuring the efficient and sustainable conservation and management of the community forest;

      (f)   keep the Director informed of any developments, changes and occurrences within the community forest which are critical for the conservation of biodiversity;

      (g)   help in fire-fighting within and around the community forest;

   (ii)   In accordance with section 32 (1) (h) of the Forests Act, the Director of Forestry requires the community forest management group the following obligations necessary for the efficient conservation and management of the community forest.

      (a)   The CFMG shall represent and be accountable to the community of the villages specified in this Agreement and operate in accordance with the agreed constitution as submitted with application for recognition (Form I).

      (b)   Revenues and other benefits accruing from the forest resource shall be equitably utilised by the community in accordance with the benefit sharing arrangements set out in the community constitution, regulations and other annexes to this Agreement.

      (c)   Shall delineate and maintain boundaries of forest areas to be under the control of the local community represented by the CFMG in collaboration with local leaders.

      (d)   The CFMG shall ensure that the community forest area be protected from destructive late fires, pests, theft, poaching, vandalism and other such forms of hazards.

      (e)   The CFMG shall coordinate with the traditional leaders to propose and enforce rules governing access, use and protection of the designated forest area in conformity with customary laws and existing regulations and local sanctions as set out in the annex 2.

      (f)   The CFMG may not assign rights, convey, sell or otherwise dispose of the community forest area to any other person or group without prior written approval of the Minister.

      (g)   The Community Forest area shall not be converted to other land-uses including permanent arable cropping and erection of dwellings, temporary or otherwise.

      (h)   The CFMG shall seek authorisation from the District Forest Officer in advance for the issuing of conveyance permits for major forest products from the community forest area.

      (i)   The CFMG shall prepare simple financial reports to be presented at regular meetings to the community in accordance with the constitution. Copies of such records of accounts may be inspected by the Director of Forestry or an authorised representative for conformity with this Agreement and its Annexes.

      (j)   Shall seek advice and inform the Traditional Authority in the conduct of the affairs and obligations of the CFMG under this Agreement.

      (k)   Shall seek support from the Traditional Authority in the control of illegal activities, enforcement of local regulations, hearing cases and ensuring sanction in accordance with accepted customary law.

      (l)   Shall seek support from the Traditional Authority with calling meetings of community members to discuss reports, endorse decisions conduct of elections of office bearers and monitor accountability of elected officials in accordance with the approved constitution.

      (m)   To seek support from the Traditional Authority with the mediation of resource use disputes when necessary, and liaise with the District Forest Officer, Local Authority and Director of Forestry as appropriate.

3.   GOVERNMENT RESPONSIBILITIES

The Director of Forestry may provide to the CFMG, information, training advice and management and extension services for community forestry management. In addition, the Director of Forestry or an authorised representative shall—

   (a)   Not issue any licences or permits for the area identified in the Community Forest Map signed by local stakeholders in Annex 1;

   (b)   Assign a marking instrument, issue conveyance permits in sufficient number and on a regular basis and within thirty days of request to the CFMG;

   (c)   Return to the CFMG, the confiscated goods or proceeds from the disposal of such confiscated goods that resulted from a case reported to the Director or an authorised representative by the CFMG at the discretion of the court, section 101 (2);

   (d)   Organise in collaboration with other partners, relevant training courses to enhance organisational, technical and management capacity of CFMG and other members of the community on community forestry management, enterprise development and marketing;

   (e)   Where appropriate, raise awareness among buyers and consumers of forest products the benefits of buying community forestry produce;

   (f)   Facilitate the undertaking of forest resource assessments, inventory and research activities as necessary.

4.   COMMENCEMENT

This agreement shall come into effect on date of signing by both parties, and shall be binding subject to adherence by the signatories to the conditions within the agreement.

5.   TERMINATION

   (i)   The Director may request the Minister to terminate this Agreement and the devolved authority contained within, in any of the following events—

      (a)   failure to protect, manage and control the illegal activities within its area of jurisdiction and fulfil the conditions and obligations listed in this Agreement; and

      (b)   failure to comply with the provisions of its agreed constitution, including failure to conduct periodic elections of office bearers, account for funds, failure to keep records of permits issued.

   (ii)   The Director shall, before terminating an Agreement, notify the CFMG of significant failures and request the CFMG to show cause, within thirty days from the date of the request, why the Agreement should not be terminated.

   (iii)   If the CFMG has not responded with effective remedial activities to rectify the issue and subsequently after all efforts to resolve or correct the situation by the Government and Traditional Authorities have failed then the Director of Forestry shall issue a final warning articulating a serious breach of the Agreement and remedial actions to be taken. If after thirty days of a written warning rectifying actions have not taken place the Director of Forestry will request the Minister to revoke the authority to control, use and manage the community forest.

   (iv)   The powers stipulated in clause 7 above, shall not be exercised by the Minister unless the Director has tried all practicable efforts to resolve or correct the situation amicably.

   (v)   The CFMG may terminate this Agreement with a notice of not less than sixty days if there is serious breach of this Agreement by the Director of Forestry in terms of their stipulated responsibilities, or for any reason the CFMG finds itself unable or unwilling to continue with the activities of the designated community forest area.

6.   DISPUTES

   (i)   Any of the parties to the Agreement may request that any dispute arising out of this agreement be referred to mediation by a mutually agreed body or person, where the Director or Minister did not invoke the provisions of Section 34 of the Act. If parties fail to agree, the Minister may invoke Section 34 of the Act.

   (ii)   In the event of any dispute arising under the Community Forestry Management Agreement, either party may refer the matter to the Minister responsible for forestry. If any party is dissatisfied with the decision passed by the Minister that party may apply for a judicial review to the High Court.

7.   ANNEXES

The following Annexes form part of this Agreement—

Annex (1) A sketch map showing the boundary of the community forest that has been signed by representatives of concerned neighbouring communities and the respective Chief.

Annex (2) A community forest management plan for a period of not less than five years for the community forest area which includes a set of community agreed rules and measures that support proper management of the community forest.

1.   Title

These Regulations may be cited as the Forest (Carbon Stock Management) Regulations, 2021.

 

2.   Interpretation

In these Regulations, unless the context otherwise requires—

"community forest management group" has the meaning assigned to the word in the Act;

"deforestation" means the conversion of forest land to non-forest land where forest land is any land with a tree canopy cover of more than ten per cent and an area of more than zero point five hectares and a tree height of five metres;

"Department" has the meaning assigned to the word in the Act;

"Director" has the meaning assigned to the word in the Act;

"forest degradation" means reduction in canopy cover while maintaining a minimum canopy cover of 10 per cent;

"forest carbon stock management" means engagement in the generation of green house gas emission reduction or removal;

"green house gas emission reduction or removal" means to measure, monitor, report and verify reduction in release or sequestration of gases like carbon dioxide (CO2), methane (CH4) or nitrous oxide (N2O) quantified in terms of carbon dioxide (CO2) equivalent;

"joint forest management committee" has the meaning assigned to the word in the Act;

"jurisdiction" means a geographic area under a Government agency and "jurisdictional" and cognate expressions shall be construed accordingly;

"jurisdictional programme" means a provincial level emission reduction programme developed by Government;

"nesting" means integration of forest carbon stock management projects into larger scale reducing emission from deforestation and forest degradation programmes;

"permit" means a forest carbon management permit issued under these Regulations;

"programme" means a province scale system or arrangement for the recognition of activities aimed at the generation of green house gas emission reduction or removal for carbon trading;

"project" means an action or activity applied to a defined geographical area, formal or organised scheme, covering an area smaller than a province, for the recognition of activities aimed at the generation of green house gas emission reductions or removals for carbon trading;

"user rights" means rights related to forest produce or forest resources;

"validation" means a systematic, independent and documented process for the evaluation of the design of a project against each of the set standards' criteria; and

"verification" means a systematic, independent and documented process for the evaluation of a project's delivery of net climate, community and biodiversity benefits in accordance with the project's validated design and monitoring plan and each of the set standards criteria.

 

3.   Eligible activities

The following activities are eligible for a project or programme in forest carbon stock management—

   (a)   deforestation reduction;

   (b)   forest degradation reduction;

   (c)   forest conservation;

   (d)   sustainable management of forest; and

   (e)   enhancement of carbon stocks.

 

4.   Areas eligible for forest carbon stock management permits

   (1) Subject to these Regulations, the Director may issue a forest carbon stock management permit in respect of—

   (a)   National Forest;

   (b)   Local Forest;

   (c)   botanical reserve;

   (d)   private forest;

   (e)   joint forest management area;

   (f)   community forest area;

   (g)   game management area;

   (h)   community partner park;

   (i)   bird and wildlife sanctuaries;

   (j)   national park; and

   (k)   private land on leasehold.

   (2) Despite sub-regulation (1), the location of a forest carbon stock management project or programme shall be subject to land use planning for each land category.

   (3) An applicant for a forest carbon stock management permit shall specify the boundaries of the forest carbon stock management project or programme.

 

5.   User rights

An applicant for a forest carbon stock management permit to engage in a forest carbon stock management project or programme shall show proof of user rights of the forest or land where the project will be located in the following manner—

   (a)   in the case of State land, a certificate of title, and consent from the Director for use of the forest;

   (b)   in the case of customary land, a community forest agreement, in accordance with the Act; and

   (c)   in the case of a protected area, a consent letter from the institution mandated to manage the protected area.

 

6.   Eligible permit holder

An eligible permit holder of forest carbon stock management consists of any of the following—

   (a)   a Government agency;

   (b)   a business agency, registered under any relevant law;

   (c)   an international organisation;

   (d)   a locally existing institution registered under any relevant law;

   (e)   a community forest management group; and

   (f)   a joint forest management committee.

 

7.   Compliance with the regulatory framework

A permit holder who is authorised to engage in forest carbon stock management shall comply with the provisions of the Zambia Development Agency Act, 2006, the Environmental Management Act, 2011, the Companies Act, 2017, and any other relevant written law.

 

8.   Expression of interest

   (1) A person who intends to engage in forest carbon stock management shall submit to the Director an expression of interest for approval in Form I set out in the First Schedule.

   (2) An expression of interest shall include the following—

   (a)   proposed location;

   (b)   stakeholder engagement plan;

   (c)   proposed carbon accounting methodologies;

   (d)   proposed market;

   (e)   proposed benefit sharing mechanism; and

   (f)   any other information related to a project or programme.

   (3) The Director may request a person who submits an expression of interest under sub-regulation (1) for further information that the Director considers necessary in Form II set out in the First Schedule.

 

9.   Approval of expression of interest

The Director shall, within 30 days of receipt of an expression of interest, approve the expression of interest if the applicant complies with the requirements of these Regulations.

 

10.   Rejection of expression of interest

   (1) The Director shall, within 30 days of receipt of the expression of interest, reject the expression of interest if the applicant does not comply with the requirements of these Regulations and inform the applicant of the rejection in Form III set out in the First Schedule.

   (2) Where the Director fails to make a determination on the submission of an expression of interest under regulation 8(1) within 30 days of the date of submission, the expression of interest shall be deemed to have been approved.

 

11.   Application for permit

   (1) A person, whose expression of interest is approved by the Director, shall apply to the Director for a permit in Form IV set out in the First Schedule on payment of a fee set out in the Second Schedule.

   (2) An application under sub-regulation (1) shall be accompanied by—

   (a)   a joint forest management or community forest management agreement with the Director;

   (b)   proof of transfer of user rights from the joint forest management committee and the community forest management group in the case of a joint forest management area or a community management area respectively;

   (c)   a consent letter from the Director of National Parks and Wildlife in the case of National Parks, game management areas, community partnership parks and bird and wildlife sanctuaries;

   (d)   proof of ownership in case of State land;

   (e)   a decision letter issued to the applicant by the Zambia Environmental Management Agency regarding the environmental impact assessment undertaken by the applicant in respect of the proposed forest carbon stock management area;

   (f)   a technical and financial proposal for the undertaking; and

   (g)   proposed methodology originating from recognised international entities and approved by the Director to quantify emission reductions, and to determine the additionality, baseline, leakage and permanence of forest carbon stocks and forest carbon stock management design document.

 

12.   Approval and issuance of permit

   (1) The Director shall, within 30 days of receipt of an application for a permit, approve the application and issue a permit to the applicant if the applicant meets the requirements of these Regulations.

   (2) A permit shall be issued in Form VI set out in the First Schedule.

   (3) A permit is valid for a period not exceeding 30 years of the date of issue.

 

13.   Rejection of application for permit

The Director shall, within 30 days of receipt of an application for a permit, reject the application if the applicant does not meet the requirements of these Regulations and inform the applicant of the rejection in Form V set out in the First Schedule.

 

14.   Application for duplicate permit

A permit holder shall, where a permit is lost, damaged or defaced, apply to the Director for a duplicate permit in Form VII set out in the First Schedule.

 

15.   Application for renewal of permit

   (1) An application for the renewal of a permit shall be made to the Director at least three months before the expiry of the permit, in Form VIII set out in the First Schedule on payment of a fee set out in the Second Schedule.

   (2) The Director may, within 30 days of receipt of an application for the renewal of a permit under sub-regulation (1), renew the permit if the applicant meets the requirements of these Regulations and has complied with the terms and conditions of the permit.

   (3) The Director shall, where the Director renews a permit, endorse the renewal on the permit.

   (4) A permit that is not renewed by the Director lapses on its date of expiry.

 

16.   Restriction on transfer of permit

A permit holder shall not assign, cede or transfer the permit to any other person.

 

17.   Suspension or cancellation of permit

   (1) The Director may suspend or cancel a permit if the holder—

   (a)   obtained the permit by fraud, negligence or misrepresentation;

   (b)   contravenes the Act and these Regulations or any other written law; or

   (c)   contravenes any term or condition of the permit.

   (2) The Director shall, before suspending or cancelling a permit, notify the holder in writing of the intention to suspend or cancel the permit specifying the reasons for the intended suspension or cancellation of the permit and require the holder to show cause, within a period of 30 days, why the permit should not be suspended or cancelled.

   (3) A notice of intention to suspend or cancel a permit shall be in Form IX set out in the First Schedule.

   (4) The Director shall, where a permit holder fails to correct the contravention within the period specified under sub-regulation (2), suspend or cancel the permit.

   (5) A notice of the suspension or cancellation of a permit shall be in Form X set out in the First Schedule.

 

18.   Nesting of projects in higher level entities

   (1) Where a jurisdictional level forest carbon stock management project or programme is developed and approved by the Director for the purpose of generating greenhouse gas emission reduction or removal, that forest carbon stock management project or programme shall take precedence over a project that is encompassed within the jurisdiction.

   (2) A permit holder encompassed within the geographical boundaries of the jurisdiction granted may only trade carbon through the jurisdictional entity.

   (3) A permit holder shall not be allowed to trade carbon independently unless with the approval of the Director.

   (4) A permit holder encompassed within a jurisdictional project or programme, that has traded carbon before the jurisdictional programme has been approved by the Director, may be granted specific permission by the Director to continue the permit holder's independent trading, for a period not exceeding three years from the date of approval by the Director of the jurisdictional programme.

 

19.   Double counting of emission reductions

A single greenhouse gas emission reduction or removal shall not be generated or monetised by two different entities or sold to multiple buyers.

 

20.   Transparency

   (1) Information submitted in a forest carbon stock management project or programme documents shall be available for public inspection during normal office hours at the offices of the Department.

   (2) Despite sub-regulation (1), commercially sensitive information may be protected, where the permit holder can demonstrate that the information is commercially sensitive and confidential.

   (3) The Director or an independent validation or verification body shall check that information designated by the permit holder as commercially sensitive does not contain information that would be required to demonstrate—

   (a)   transparency in accounting methods;

   (b)   benefit sharing arrangements;

   (c)   baseline scenario;

   (d)   additionality;

   (e)   estimation and monitoring of green house gas emission reduction and removal; and

   (f)   other important matters related to forest carbon stock management project or programme.

   (4) A permit holder shall provide any information requested by the Director including contractual and pricing information from carbon buyers.

   (5) The Director may suspend or cancel a permit where a permit holder does not comply with sub-regulations (3) and (4).

   (6) Information in project or programme documents related to the determination of the baseline scenario, demonstration of additionality, and estimation and monitoring of green house gas emission reduction and removal shall not be considered to be commercially sensitive and shall be provided in the public versions of the project or programme documents.

 

21.   Monitoring, reporting and verification

   (1) A permit holder shall comply with the monitoring, reporting and verification requirements set out in these Regulations in accordance with methodologies approved by the Director.

   (2) Despite the generality of sub-regulation (1), the permit holder shall—

   (a)   for the purpose of validation and verification, provide data and parameters used for the quantification of green house gas emission reduction or removal in accordance with the approved methodology;

   (b)   comply with nationally recognised verification requirements;

   (c)   establish and apply quality management procedures to manage data and information;

   (d)   establish a green house gas information system;

   (e)   provide a monitoring plan in accordance with approved methodologies; and

   (f)   provide any other relevant information.

   (3) A permit holder shall, within 30 days before commencement of the verification and validation notify the Director.

   (4) The Director shall assign a forest officer to take part in the validation and verification.

 

22.   Safeguards

A permit holder shall incorporate in the project or programme design and implementation, the social, environmental and fiduciary safeguards in Form XI set out in the First Schedule.

 

23.   Benefit sharing

   (1) A permit holder shall submit that permit holder's benefit sharing mechanism to the Director for approval.

   (2) Subject to sub-regulation (1) a benefit sharing mechanism shall—

   (a)   contain a benefit sharing agreement executed by all interested parties;

   (b)   be developed jointly with all interested parties;

   (c)   contain auditable bench marks; and

   (d)   be derived from the gross revenue of carbon credits sold.

   (3) A permit holder shall make public an approved benefit sharing mechanism.

   (4) A benefit sharing mechanism shall be periodically reviewed after the benefit sharing mechanism becomes operational.

 

24.   Risk assessment

   (1) A permit holder shall demonstrate adequate management capacity and ability to address forest carbon stock management permanence risks during both the planning and operation of the forest carbon stock management project or programme.

   (2) A permit holder shall submit a risk assessment and management plan to the Director.

   (3) The Director may suspend or cancel a permit where a permit holder does not comply with sub-regulation (2).

 

25.   Records and information

A permit holder shall ensure that all documents and records are kept in a secure and retrievable manner for at least seven years after the end of the crediting period.

 

26.   Trade and disclosure

A person shall conduct a carbon transaction in accordance with the existing legislation on carbon trading, and take into account the Republic's international obligations.

 

27.   Register of permits

   (1) The Department shall keep and maintain a register of permits in Form XII set out in the First Schedule.

   (2) The Register under sub-regulation (1) shall be kept at the offices of the Department and shall be open to the public for inspection during normal office hours on payment of a fee set out in the Second Schedule.

 

28.   Fees

The fees set out in the Second Schedule are payable for the matters specified therein.

TERMS AND CONDITIONS OF FOREST CARBON STOCK MANAGEMENT PERMIT

1.   The permit holder shall be governed by the laws of Zambia and other international and agreements that Zambia is party to.

2.   The permit holder shall comply with the provisions of the Forest Act, 2015.

3.   The permit holder shall provide data and information to the Department related to forest carbon stock management.

4.   The permit holder shall provide information related to the volume of emission reduction, buyer, prices, commitment period for such transaction and any other information as requested by the Director.

5.   The permit holder shall demonstrate transparency in accounting methods, baseline scenario, additionality, estimation and monitoring of greenhouse gas emission reduction and removal and other important matters.

6.   The permit holder shall provide periodic updates on the management of carbon stock and any information that may be necessary in relation to forest carbon stock forest management.

7.   Public disclosure shall be mutually agreed throughout the project implementation time.

8.   The permit holder shall develop a project or programme design, emission document or emission reduction document or related document depending on the carbon standard and the said document shall contain full information regarding the areas, size, benefit sharing plan, redress mechanism, obligations of the permit holder and all other environmentally and fiduciary information.

9.   The benefit sharing plan shall clearly outline the gross revenue and the break down on how the gross revenue shall be shared.

10.   The permit holder shall follow all environmental and social safeguards as guided by the Director.

11.   The permit holder shall apply the precautionary principle in the development, management and conservation of forest ecosystems, biological diversity and habitats, taking into account the best scientific evidence available.
